COMMITTEE SUBSTITUTE FOR SENATE BILL NO. 605 - By: SMITH of the Senate and HASTINGS of the House.
[ marriage and family - Forgotten Youth Act ? consent ? misdemeanor ? codification ? emergency ]
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION . NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 110.2 of Title 43, unless there is created a duplication in numbering, reads as follows:
This act shall be known and may be cited as the "Forgotten Youth Act".
SECTION . NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 110.2a of Title 43, unless there is created a duplication in numbering, reads as follows:
As used in this act:
1. "Child" means any person under eighteen (18) years of age who has been subject to a court?s jurisdiction in a domestic relations case;
2. "Facility" means a place or an institution used for the lawful custody and treatment of children on a twenty-four-hour basis, with no grievance mechanism for children, which includes but is not limited to detention of a child in the facility under lockdown or other restraint of a child?s liberty; and
3. "Court of jurisdiction" means the district court which has jurisdiction of the domestic relations case to which the child is the subject.
SECTION . NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 110.2b of Title 43, unless there is created a duplication in numbering, reads as follows:
A. Prior to admittance of a child to an out-of-state facility, a custodial parent who is subject to the jurisdiction of the domestic relations court shall submit a consent form signed by both the custodial and noncustodial parent to the court of jurisdiction.
B. Failure of the custodial parent to submit a consent form pursuant to subsection A of this section prior to a child?s admittance to an out-of-state facility shall constitute a misdemeanor.
SECTION . It being immediately necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this act shall take effect and be in full force from and after its passage and approval.
