IMO it is the parents responsibility to know and make sure that their child is protected and being treated in the way that all human beings deserve to be treated.

I think the escort is not only attempting to protect themselves from future litigation but they are also saying they can't control the actions of others.  That is a pretty big red flag.  If parents who sign these types of contracts can't see that, well then....

Well, good.

Groups that kidnap kids are bad.

Parents that hire kidnappers to kidnap their kids are abusive.

The parents usually can't successfully be sued for the child abuse.

If the kid can sue the kidnappers and win, and it hits the parents, then the kid can get his/her money for college without having to agree to go into yet another post-18 "program" and can get on with his/her life.

A few parents taking it hard in the pocketbook from their grown kid suing the escort agency and the word will spread---through the parents' homeowners' or renters' insurance if nothing else--that using escort agencies is bad for your financial health.

Good.

OTOH, if the agency in any way misrepresented itself to the parents, the indemnification clause won't hold up in court.  Also, if the parents have spent themselves into debt on programs and are in a "can't get blood from a turnip" situation, the indemnification clause won't protect the escort service from having to cough up the dough to the kid.

What this basically means is that if the kid sues the escort service, the escort service has to pay the kid, but will then have to sue the parents to recover---and if the parents don't have it, the escort service is still in a world of hurt, because they *still* have to pay the judgement to the kid, regardless of whether or not it's going to be possible for them to recover their costs from the parent.

well then- the kids should not suffer because of the parents- they probably need new advocates that will ensure that they are free from abuse.

I agree.  The kids should not suffer.  Maybe if a few parents were held accountable for their neglect then other parents would learn to be more involved in the choices they make for their kids.  As far as escorts go, if parents so choose to use them, then why donn't the parents accompany the escorts?  Then once in the program, the parents could be involved in the treatment process, directly involved that is.  Invovled to the point they are visting the child regularly and participating in the childs treatment.

When you think about it, this just reinforces the kind of divisive cult experience on the family

Basically if the kid wants to sue the escorts he is in effect suing his own parents which would probably make it harder to reconcile with them even if he wants to later.

Any lawyers out there that can tell us whether an agreement to pay the legal fees of an escort company is valid? I know there are some aspects of law where someone promises to pay the debts (legal fees) of another that have a lot of extra rules and restrictions.

I do agree however that this is definitely a good way for a kid to get back at parents that still believe in the program bs. By suing the escorts, and I would imagine that many programs have this clause as well in their enrollment contracts, the kid is effectively suing his own parents because they will be the ones held responsible for the legal costs. I guess this means a parent better make a good choice in escort companies and programs because if the kid decides to sue when he is an adult its the parents who foot the bill. Of course if parents are paying the legal fees, they may have the ultimate right to decide to settle or fight. Any lawyer opinions on this?
