RBWO = ROOM BOARD AND WATCHFUL OVERSIGHT  

 RBWO'S - Why Move to RBWO?  
• The Georgia Department of Human Resources (DHR) was
instructed by the Federal Government, through their Centers
for Medical and Medicaid Services, to "un-bundle" the
behavioral and mental health services currently paid through
the Department of Family and Children’s Services Level of
Care system.
• The new process, that began on July 1, 2007, offers private
child placing agencies or child caring institutions, who accept
the placement of state children, to be paid a per diem based
only on the level of room, board, and watchful oversight
(RBWO) required.
• Any behavioral or mental health services to the child would be
provided by a Medicaid Provider of these services.

According to court records, doc. 64 FILED 09-27-09 PAGES 9-11, under "RIDGE CREEK SCHOOL BUDGET" SEPT. 2009- AUG. 2010 , "RIDGE CREEK WILDERNESS" and "CREEKSIDE" BUDGETS are on hold "PENDING RELEASE OF FUNDS FROM THE STATE OF GEORGIA WHICH HAS PLACED A FREEZE ON ALL PLACEMENTS BY THE DJJ AND DEFCS.

** " THE PROJECTED INCOME FROM RCW AND CREEKSIDE WAS TO BE 75,000. PER MONTH PROGRAM AND CAN BE ACTIVATED IN TWO DAYS WITH MINIMAL OPERATIONAL COST."

Perhaps taking on MORE children is more appropriate. The court document is in conflict with the award payments throughout the year.  The court document was provided by HLA, now RCS, during the bankruptcy hearing.  The court document states "Creekside" and "Ridge Creek Wilderness."  The court document via Buccellato attorney's states  " a freeze."  Yet according to state funding, the funds were paid. The township stated  "Creekside" was never a reigstered entity, which according to the township, even if it falls under the larger corporation, it must be registered.  
"Creekside" web-site was established in 2009...? then dismantled, and totally cleansed from the internet. No record of it with the State of Georgia either.  Technically, every which way, it did not/ does not exist. Yet the court documents state it did.  According to the Sec. of State, there is no/was no Creekside.  According to the ORS - ORCC there is no Creekside.  Yet, Creekside pops up on court record submitted by Buccellato's bankruptcy attorneys.  Mistake.

Apparently,the town council has no clue that RCS back-doored DJJ funding and adjudicated children on the property, which the town shot down when Mountain Brook Academy was thwarted;  although Mountain Brook - Ridge Creek appears to exist on paper and is an active CCI entity according to Keith Bostick of the ORS.

Sounds like Creekside may have been defined too soon, before HLA was buried,  had too many finger prints and/or was contaminated on paper (i.e. had ties back to HLA or a legal entity that would have exposed it to lawsuits from the past).  When redefining yourself you need to start out 100% clean so they may have dumped their first attempt (Creekside) and then went with Ridge Creek Inc.
From a legal standpoint companies need to cover their tracks and insure everything is thoroughly cleansed before starting out again.  Maybe it was as simple as they didnt want to be tied into the state from the beginning to see if they could make it as a 100% out of pocket entity, but they already applied to the state under Creekside and desperately wanted a Mulligan.  Maybe someone else had the name Creekside which would have interfered with their internet searches (slim chance).... etc.

KEY points here:

A)  Stimulus funds for Ridge Creek, Inc. and various other like RBWO facilities received stimulus fund grants/awards under Award Number S397A090011 in Georgia and across the country.

B)  Ridge Creek, Inc. does not inform new families /ed cons of intent to house juvenile offenders on same property nor does it disclose is also an RBWO with DJJ contracts in place.

 Non-disclosure - This opens educational consultants and Ridge Creek, Inc. to vulnerability where a lawsuit would arise from injury of say an ADD child perpetrated by an violent offender.  Although according to the DJJ, RCS, Chris Grimwood orginally contacted them about "taking low-level offenders," which does not appear to be the case from the reports coming out of Ridge Creek School.  The DJJ Official was also assured separate housing and facilities.

If much of the per diem is based on the level of "watchful oversight", RC might not be in the black for years to come, if ever.
How many violations of State Regulations and visits by Law Enforcement does the Gub allow before they stop paying?
Do the conservatives of Dahlonega know what's happening out there? Is the media covering this stuff? I know they love the donations and the tax dollars, but security has to be a higher priority at some point.

Findings include: Review of medical record #2 conducted December 15, 2010 revealed that the
agency failed to maintain a complete record of all medication handed-out by staff and taken by
the children. There was no documentation of the date and time taken, dosage taken, name and
signature of staff member for the following medication: Resident #2: Amphetamin ER 20mg
TEV (generic for Adderall) 1 tablet (not given 12-1-10 to 12-6-10). There was no other
documentation in the file. Interview with staff F conducted December 15, 2010 at 12:30pm
acknowledged the findings and revealed that the agency had to get approval from the parents to
administer the medication, Amphetamin ER 20mg TEV. This was previously cited December 10,
2009.

A brief exit conference was conducted on site. Although a formal written plan of correction is not
due to the surveyor until receipt of the final statement of deficiencies, all citations are expected
to immediately be brought into compliance with the rules and regulations. This is the final

by February 1, 2011.
