So the reasons for kids being placed in programs is multifaceted and each case needs to be looked at individually.
If by "individually" you mean due process with a right to appeal plus guaranteed long term legal representation and no forced treatment of any kind whatsoever ever, then yes, I agree. If kids are going to be held against their will (imprisoned), you might as well offer them the same rights they would get as prisoners (even minors).
No, what is meant by individual is as it applies to “Each family”. Some kids are not responding to local services, others have drug issues and still others have family/personal issues that can not be dealt with or successfully dealt with locally etc.
As far as representation or due process, I don’t think we can apply this to kids. Kids will always be held against their will (whether it be at home or away) until they become old enough to take care of themselves. This is the way it is in every family. As far as giving them the same rights as prisoners, I don’t think this would be very effective for most. Kids need much more exercise then prison offers and could do without the HBO 24/7. They would be better off at home or someplace where they would be getting help to get back on track. vs a prison setting.
I have heard many here indicate that prison life would be better for these kids but it would be a disaster. Statements like these I believe are born out of hatred for the programs that some here attended and would not benifit any child in my opinion.
I think if we could get the opinion of a childs guidance counselor or therapist prior to placement this could be a huge step in deterring kids from being placed unnecessarily.
