Are you refering to a parent placing without the other's knowledge and/or permission?
In all the cases I am aware of, the opposing parent had to take the matter up with family court- a violation of the court ordered rights. Depends on the judge, and the effectiveness of the TBS to convince the judge that the child needs their 'treatment'.
A few have been successful in having their child removed, many have not. Instead they found themselves in lengthy custody battles, running into the tens of thousands of dollars, and not resolved before the child 'graduates'.
The opposing parent should have a more timely recourse.
