I am preparing a list of Midland straight survivors to take to the Midland Independent School District.  I am going to challenge them to show me ONE diploma received by any of us.
 
CURRENT TEXAS EDUCATION CODE
25.085 Compulsory school attendence requires persons 6-18 to attend school.
EXEMPTIONS  25.086  There are many, but the one that applies to drug treatment states (physical or mental condition of a temporary and remmediable nature, AND holds A CERTIFICATE FROM A QUALIFIED PHYSICIAN.  I was withdrawn from school without a doctors statement. MISD supported straight, allowing the withdraw of several students knowing that the program prohibited education on 1st and 2nd phases and that they would remain out of school for an indefinate amount of time. Under current law Straight practices would be in violation of the education code.  This code has been amended since my time at straight.  I have not been able to find the code from 1986, but I'am still looking.
There is also a federal code which I plan to research.  
 
I am asking everyone to research the education code of the state they lived in during their straight time.  And ask the school district that withdrew you for your records, specifically withdraw documents.  If you find violations, file a federal suit for sure and a state suit if your state allows it.  When hundreds of school boards across the country start facing civil rights violations, light will shed upon our cause and we will help President Bush to "leave no child behind."  "

I have an attorney, Ian Cantucuzane, in Midland, TX sitting on some straight issues, the school thing being one of them.  I also wanted to go after the juvenile probation/court system.
Ian agreed to take the case as a "team player"
with hopes that attorneys from previous and current straight cases would share info with him.
Of the people we tried to contact, None returned any messages. Maybe someday though???

Melissa Hendrix is the current MISD director.
She is a former newscaster of Midland and very anti straight.  In a 1999 interview with her and a reporter with the Midland Reporter Telegram I brought up my experience in Straight.  Ms. Hendrix was already familuar with Straight and very much against their tactics.  I remember her saying that Straight clients came out with violent tendencies.

Shortly after the interviews I called to recant my story for the reason that I didn't want that part of my life to be public knowledge.  Ms. Hendrix agreed not to air my interview, but the MRT said "it's already done and going to print."
So I called Ian, same lawyer. He told them that I was quitting music, wanted out of the public eye and would return to college and live a quit life.  And if they printed anything about me I'd file suit.  So nothing went to print.

Little did I know what my future would hold.

With regard to your second post, I think we have all dropped the ball in one way or another over the years with respect to Straight issues.

Your idea is excellent. I have started requesting various records of my own.

Laws in Ohio appear to be about the same as TX. I am curious to know how KHK and Ohio schools dealt with this.

Current and former KHK prisoners, try requesting a copy of your school record. What is on your record regarding your absence from school during your time in KHK?




[The paragraphs below are excerpted from: ยง 3321.04. Scope of parent's duty; excuses from attendance, from the Ohio Revised Code. For the Ohio Revised Code go to : http://www.legislature.state.oh.us/laws.cfm and click on Ohio Revised Code, then on TITLE XXXIII EDUCATION - LIBRARIES to get to the education code.]



"...Excuses from future attendance at or past absence from school or a special education program may be granted for the causes, by the authorities, and under the following conditions:  

(A) The superintendent of the city or exempted village school district or the educational service center in which the child resides may excuse the child from attendance for any part of the remainder of the current school year upon satisfactory showing of either of the following facts:  

(1) That the child's bodily or mental condition does not permit attendance at school or a special education program during such period; this fact is certified in writing by a licensed physician or, in the case of a mental condition, by a licensed physician, a licensed psychologist, licensed school psychologist or a certificated school psychologist; and provision is made for appropriate instruction of the child, in accordance with Chapter 3323. of the Revised Code;  

(2) That the child is being instructed at home by a person qualified to teach the branches in which instruction is required, and such additional branches, as the advancement and needs of the child may, in the opinion of such superintendent, require. In each such case the issuing superintendent shall file in his office, with a copy of the excuse, papers showing how the inability of the child to attend school or a special education program or the qualifications of the person instructing the child at home were determined. All such excuses shall become void and subject to recall upon the removal of the disability of the child or the cessation of proper home instruction; and thereupon the child or the child's parents may be proceeded against after due notice whether such excuse be recalled or not.  

(B) [irrelevant]

All excuses provided for in divisions (A) and (B) of this section shall be in writing and shall show the reason for excusing the child. A copy thereof shall be sent to the person in charge of the child.  

(C) The board of education of the city or exempted village school district or the governing board of the educational service center in which a public school is located or the governing authorities of a private or parochial school may in the rules governing the discipline in such schools, prescribe the authority by which and the manner in which any child may be excused for absence from such school for good and sufficient reasons.  

The state board of education may by rule prescribe conditions governing the issuance of excuses, which shall be binding upon the authorities empowered to issue them."

I called to get my complete school records, but in Fairfax County they were destroyed after five years. I will post on the other survivor sites about getting records as soon as possible.

That sounds odd.  Surely they at least have your transcripts.  Sometimes people wait longer than 5 years after high school to attend college.  And most colleges request transcripts.
Transcripts have withdraw dates and reasons for on them.  Or at least mine does.  Midland Lee High has everything on computer.  Anyone who has attended Lee can request their transcript and they print it right then at no charge.

You are right, they do keep transcripts. I had thought that only my grades would be on there. I will order a copy and see what it says.
