Embattled ´Tough Love´ Schools Win Major Victories
ST. GEORGE, Utah, Jan. 09 /PRNewswire/ --

ST. GEORGE, Utah, Jan. 9 /PRNewswire/ -- The World Wide Association of Specialty Schools and Programs (WWASPS) won two major victories today, rebuffing a final attempt by litigants to sue the school for abuse of its students, and hearing that the Department of Justice will not undertake an investigation into its practices on jurisdictional grounds.

"We're relieved, although we feel that there was certainly nothing to fear with a potential investigation or lawsuits," said Ken Kay, WWASPS president.

In response to Rep. George Miller's (CA-D) written request, the Department of Justice declined to look into accusations of abuse at schools affiliated with WWASPS.

William E. Moschella, assistant attorney general, responded to a letter from Miller, originally written to Attorney General John Ashcroft, soliciting the Justice Department's help in investigating accusations including abuse, human rights violations, fraudulent and deceptive advertising, fraud and unjust enrichment under the Internal Revenue Code.

Because the WWASPS institutions are both privately-owned and two are currently located outside the United States, these conditions exceed the department's jurisdiction, preventing it from taking further action according to the letter.

"If Congressman Miller would have accepted our invitation to tour the schools and meet with myself and the directors, he quickly would have discovered that his allegations are unfounded," said Kay.

Embroiled in eight separate lawsuits since November 1998, WWASPS recently had all eight cases dismissed on the grounds of lack of evidence. Several had been through the Court of Appeals. California attorney Thomas Burton filed these cases in the Federal District for the District of Utah, naming WWASPS, Teen Help (a WWASPS affiliate), and various officers and employees as defendants.

"We've never lost a lawsuit or had to settle," said Kay. "These dismissals further solidify the falsity of the many accusations made against WWASPS. We are proud of this record as it is strong evidence that what we have done nothing wrong. This is despite the fact that the media continues to attack us based on the voices of a few naysayers."

All cases claimed negligence, child abuse, fraud and racketeering, yet no admissible evidence was produced to support of these claims. Four of these cases were appealed to the 10th Circuit Court of Appeals in Denver after being dismissed by Utah Federal District Court judges--these dismissals were upheld.

ST GEORGE, Utah, Feb. 05 /PRNewswire/ --

ST GEORGE, Utah, February 5 /PRNewswire/ -- The country's leading association of schools for troubled youths filed a federal lawsuit today against a reporter who made disparaging comments about it and one of its member schools in telephone interviews with parents.

The Utah-based World Wide Association of Specialty Programs and Schools (WWASPS) together with the Academy at Ivy Ridge ("Ivy Ridge") based in Ogdensburg, NY, seeks legal relief for "tortious interference with contract" in the civil suit filed against United Press International reporter Thomas Houlahan.

The suit, filed in the U.S. District Court in Salt Lake City, states that Houlahan called a specified Ivy Ridge parent in January 2004. Instead of interviewing the parent, Houlahan proceeded to advise the parent to remove her child from the school and the WWASPS system, severely maligning WWASPS in the process.

"The parent in question called me in a state of extreme anxiety," said Ken Kay, WWASPS president. "She was concerned about her son, as anyone would be. As soon as we told her about Mr. Houlahan and his agenda, she calmed down and emailed us the detailed notes she took during the exchange with Mr. Houlahan."

Kay states that he knows of similar instances in which Mr. Houlahan has called parents and alleged falsities.

"I don't know Mr. Houlahan's motive, but it seems to me that he is blatantly trying to interfere in our business in the most negative fashion," Kay said. "As such, we felt forced to take legal action to stop his campaign against us.

"Mr. Houlahan has gone beyond being a dedicated reporter. He has become what we can only term a destructive and biased force."

Ivy Ridge is one of seven schools associated with WWASPS in the United States. The association also has two schools operating outside of the country, one in Mexico and the other in Jamaica. WWASPS member schools have successfully worked with more than 15,000 students, making it the largest organization of its type in the country.

Yeah, I would agree except for the fact that someone has suggested that this guy is a freelance journalist which troubles me a little bit. However, maybe this is not even an issue, meaning Houlahan is covered under the UPI umbrella under the terms and conditions of his association with them as a freelance journalist. Interesting to see how this plays out.  Any other journalists who have written about WWASPS been sued?  Personally, I have not heard of any, which is another reason why I find this complaint rather troubling.

From what I understand Thomas Houlahan had spoken with and documented many experiences from students recently home from the wwasp program.

Maybe what he had learned from these kids, he had reason to be concerned for the woman's son.

Too bad she wasnt opened to the possibility he may have been sharing out of true concern,safety  for her son.

T H has legal expertise. He can handle this .
