MINUTE TEXT: The Court discussed pending motions [96]Motion for Enforcement of
Settlement and Judgment and [100] Motion for Payment of Excess
Foreclosure Proceeds, with the parties and requested update on case
status. Plaintiff's counsel outlined settlement, stated that the case is in
the same posture, there has been no satisfaction of settlement by the
defendant's, requested the Court issue an order directing the defendant's
to pay settlement amount or to at least produce financial documents
regarding financial situation, discussed possible bankruptcy by the
defendant's. Defense counsel responded regarding the defendant's
financial situation, addressed bankruptcy issue, stated that defendant
continues to seek refinancing, defendant's have retained bankruptcy
counsel to explore all possibilities, stated that he has sent plaintiff's
counsel financial documentation that should be sufficient. The Court
stated that there is already a judgment against the defendant's, does not
believe further court order will resolve this issue, the court directed the
parties, once plaintiff's counsel receives most recent documentation, to
review the documents, and to request in writing if more documentation
