THE CHAPEL FUND REVISITED-WHERE THE HELL IS THE IRS

THIS IS ENOUGH TO MAKE ONE SICK AND IT SPEAKS FOR ITSELF AND THE LACK OF INTEGRITY, OF ONE LEONARD BUCCELLATO.  MY CHILD ATTENEDED HLA LONG AFTER 2002 AND I CAN TELL YOU THIS, THERE WAS NO "GROUND BROKEN" FOR THE CHAPEL AND WE WERE TOLD THE SAME GARBAGE ABOUT ABOUT BREAKING GROUND SOON.

ASPEN EDUC. GROUP SECURES $15 MILLION FUNDING
(April 17, 2002) Aspen Education Group, Elliot A. Sainer, CEO, 562.467.5507, announced it has obtained $15 million in additional funding from Warburg Pincus, the global private equity firm. The additional funds will be used to “promote company growth, while permitting Aspen to expand both its geographic reach and programs for its clients. Along with our two existing equity sponsors, Sprout Group and Frazier & Co., we are very fortunate to have three strong financial partners who support the work that we do with youth and their families,” according to Sainer.

HIDDEN LAKE ACADEMY CHAPEL BREAKS GROUND
(May 2002) Hidden Lake Academy, Dahlonega, GA, 800-394-0640, has broken ground for the new chapel, this May, thanks to support from various donors who have contributed to the building of the new chapel.

I attended HLA 03-04...and i never saw the chapel "break ground".

I saw the construction of a new academic building, and beggings of a new admin office, the construction of a toilet and the reflooring of the gym.

but no chapel

at one point they had a little area staked up in the area where the chapel was supposed to be - it was designated by a few stakes with ribbons and a bulldozer in the corner. they had that up starting with grandparents day and they left it for a ed-con tour a few weeks later, and had a little station set up by the area with students asking for donations to the chapel fund. as soon as all that was over the bulldozer disapeared and the stakes were taken out. the area staked out to be the chapel was no where near big enough for one anyway - it was big enough for a 50-70 person congregation, yet at the time the school had 150+ students and nearly another hundred staff.

Now HLA has a "Convocation Center Fund", now since Hidden Lake Foundation, Inc. and thus the Chapel Fund are gone, I expect that there shall be accountability for the "Convocation Fund Center" donors???  When was this established?  It was after the lawsuit was filed.  990 filed?  Or is this one "off the books" too.  How can all you people that donated or years allow this fraud to get away with this?

Hidden Lake Foundation, Inc. is one of the entities being sued.  Wouldn't Buccellato NEED to tell the court he dissolved it...?
AND, is Buccellato allowed to dissolve the foundation when it is named in a lawsuit? A source revealed Buccellato said that funds were used to pay attorneys fees from the suit...thus, Buccellato said he dissolved Hidden Lake Foundation, Inc.( established for "The Chapel Fund").  And, we all know it had been personally bilked before the lawsuit was even filed.

At the very least, Buccellato owes a letter of apologie to all those families, ed.cons and especially Patrick Kennedy's family, who believed in HLA because they had nothing else to hold onto, that were fraudulently led to donating to "The Chapel Fund".
 
Affidavit on the horizon for the source, by Berger and Montague?  Or the Feds??

Hidden Lake Foundation, Inc. that was 'created'? for "The Chapel Fund" was not a registered  entity with the Secretary of State until 03-30-2005.  Registration ceased in 2007.  Donations for the chapel, per HLA donation forms were asked to be written out to HLA, INC. non-profit school.  Apparently the funds were co-mingled into HLA, INC. and not used toward the building of the chapel, obviously.  Therefore, one would assert that since there was no Hidden Lake Foundation, Inc. prior to 2005, the monies collected went into HLA, INC.  Prior to 2005, those of you that generously gave to what you thought was the chapel fund, actually went into HLA,INC. and from what I am told, the donors included not just families, businesses and ed cons.  Mr. Croke was either wrongly informed or came to the wrong conclusion himself, that Hidden Lake Foundation Inc., soley created for "The Chapel Fund" was dissolved to pay legal fees as Hidden Lake Foundation, Inc. was cited in the lawsuit, thus the chapel fund was no longer.  The chapel funds should have been restricted, but by putting them with HLA,INC. the funds were readily available, co-mingled.  990's for Hidden Lake Foundation, Inc. did not 'need' to be filed, no funds, at least prior to 2005, Hidden Lake Foundation, Inc. did not exist, however no records after 2005 either.  Also, if one checks the 990's for HLA, INC., one will be able to figure out
what transpired - no restricted chapel funds.

I think this is a pertinent question...Will "The Convocation Center" funds be restricted ?  Are donors writing their checks out to HLA,INC. or  L&K Holding Co. LLC...  It appears other entities have gone into L&K Holding Co. LLC, by way of very 'creative' design.  The routing of properties seems quite colorful over the last couple years. "Mapquest" would have a difficult time. Here is an idea, why doesn't Buccellato pay the settlement to the plaintiffs by way of assigining a few of his properties over  as collateral or whatever, quit claims seem to be apparent the last few years; and, the plaintiffs in turn, can turn around and sell it back to him for one dollar, plus, etc. etc.  Then the assigned property  previously belonging to Buccellato, Hidden Lake Academy, etc can go into L&K Holding Co. LLC. ... which is not named in the class suit. Amazing scenario.  Thus if Buccellato is sued again, surprise, he has no assets...  Most people think this can only be done with money, think again.  Of-course, it's only a possible scenario, but then again, why would Berger and Montague name Thornton Morris and L&K Holding Co.LLC in their filings to seek joint assets?? Or the whereabouts of such assets...  ah, State of Georgia records..... quite interesting reading......forensic accountant anyone?

In 2001 Greg LIndsey, former headmaster, declared in the above letter that the Chapel Fund reached 300,000 dollars - that was 2001. Hidden Lake Foundation, Inc. was not a entity until 2005, thus not created for the Chapel Fund as some have speculated.  The funds were not secured or resricted.

BOULDER CREEK ACADEMY STUDENTS RETURN FROM BELIZE

POSITIVE IMPACT ANNOUNCES NEW STAFF

STILL SOME SPACE ON DENMAN’S SUMMER ALPINE TREK

SQUAREONE REFINES PROGRAM

(June 11, 2002) Mildy McDaniel stopped by Woodbury Reports to introduce Tony DeVall, her new assistant at Intermountain Hospital, Boise, Idaho, and to describe the expansion of their adolescent residential program, which has added 30 beds. She also mentioned one of their therapists, Bonnie Thorpe, has been certified in Dialectical Behavioral Therapy.

ALLDREDGE ACADEMY SUIT SETTLED
(June 12, 2002) It was announced that the suit against Alldredge Academy, Davis, West Virginia, 888-468-1828 regarding the death of Ryan Lewis almost one and a half years ago, was settled. Charges against L. Jay Mitchell and John Weston were dismissed with prejudice, and the court accepted a plea of Nolo Contendere by Alldredge Academy, meaning they decided to not contest the charges without admitting guilt, which carries a maximum fine of $5,000. MEL WASSERMAN MEMORIAL AT HIDDEN LAKES GOLF RESORT
(June12, 2002) On Monday, July 22, 2002, at 2:00pm there will be a Selkirk School Scramble & Mel Wasserman Memorial for the year 2002. This golf tournament is for players of all abilities. According to Stacy Wasserman-Temple, Tournament Coordinator for Selkirk School, Sandpoint, Idaho, 208-263-4931, the tournament will generate sponsorship funds that will be utilized in increasing the funding for Selkirk School. Meals will be waiting for players after the round, with a silent auction taking place during dinner.

BROWN SCHOOLS LAUNCHES SCHOLARSHIP PROGRAM
(June 12, 2002) Marguerite Sallee, President and CEO for The Brown Schools, Sandpoint, Idaho, 208-265-0607, announced their new scholarship program for the CEDU Emotional Growth Boarding Schools, including Boulder Creek Academy, CEDU High School, CEDU Middle School, Northwest Academy, and Rocky Mountain Academy. Providing discounts to families who are not able to pay the full tuition, these scholarships will be based on level of need and available space. The goal is to provide $1 million dollars in scholarship assistance each year. This complements the financial aid services already offered through loans, third-party reimbursement, discounts, and foundation giving. IRS Complaint Process For Tax Exempt Organizations

The Internal Revenue Service gives serious consideration to complaints made alleging the abuse of the tax exempt status granted to certain organizations.
When reviewing filed complaints, the IRS carefully follows special procedures designed to assure the public of the IRS’s objectivity in the treatment of tax-exempt organizations.  These procedures ensure that the IRS operates in an unbiased and appropriate manner and that its compliance programs are not improperly influenced by outside intervention.
The responsibility for administering these procedures belongs to the Exempt Organizations (EO) function, which is part of the IRS’s Tax Exempt and Government Entities Operating Division.
Complaints (Referrals)
A complaint (also called a referral) is any communication alleging that a tax-exempt organization is in potential noncompliance with the tax law.  EO receives complaints from the general public, members of Congress, federal and state government agencies, as well as from other parts of the IRS.
Filing a Complaint
A referral of an exempt organization may be made by submitting Form 13909, Tax-Exempt Organization Complaint (Referral) Form, downloadable from IRS.gov.

Form 13909 and any supporting documentation may be submitted in a variety of ways.  They can be sent via:
•   Mail to IRS EO Classification, Mail Code 4910DAL, 1100 Commerce St., Dallas, TX 75242-1198,
•   Fax to 214-413-5415, or
•   Email to eoclass@irs.gov.
Submission of Form 13909 is voluntary.
Acknowledgement and Disclosure Prohibition
All referrals are sent to analysts at the EO Classifications Office in Dallas. After a referral is made, the IRS will send an acknowledgement letter to all non-IRS sources making a referral, unless it was made anonymously.
Section 6103 of the Internal Revenue Code prohibits the IRS from disclosing whether it has initiated an examination or the results of any examination. Therefore, the IRS cannot communicate with the original source of a referral beyond the acknowledgement letter.
The Review Process
Upon receipt, research is done to confirm the identity of the organization in question and once this is complete, information is entered into a database to help the IRS keep track of the progress of the review.
An experienced EO revenue agent then performs a thorough technical analysis of the allegation made on the referral. The agent uses a “reasonable belief” standard to evaluate the facts and to determine whether EO should take further action.  Before taking action, the revenue agent must determine that the facts create a reasonable belief that the allegations may be true when considered fairly and in light of other reliable information.
The reviewing EO agent will decide one of the following:
•   The information does not warrant further action. In this case, the agent inputs information, including rationale, into the database and closes the referral.
•   The referral relates to activities that should be considered at a future date. The agent documents the database and schedules the appropriate date to re-evaluate the information.
•   The referral contains characteristics that require it to be forwarded to a committee of career EO managers and agents. This committee evaluates referrals monthly -- more often in some circumstances -- and decides whether to proceed with an examination. The committee also applies the “reasonable belief” standard.
•   The information warrants an examination of the organization. The agent documents his or her decision and the reasons for it in the database. The information item then becomes part of the examination file.
If this process results in a decision to examine an organization, the Classification Office will forward the case to a field group for assignment to a revenue agent.  The revenue agent will contact the organization and schedule an appointment to begin the examination.  (For details on the EO examination process, see Fact Sheet 2008-14.)
