Complainant: ISAC Corporation          Against: KHK

COMPLAINT SUMMARY:

1.Complainant reports that new clients are forced to be "beltlooped" and this is a form of constant restraint. He states that "beltlooping" is a form of humiliation and source of potentially harmful psychological and emotional side effects.

2.Complainant reports that "newcomers" are not allowed privacy while using the bathroom.

3.Complainant reports that "newcomers" are not allowed to watch TV, listen to the radio, or read, call home, tell their parents where they are living and are not allowed to carry identification or any other personally identifying object.

4. Complainant reports that "newcomers" are locked in the bedroom of the homes of families they are residing with at night in only their underwear. He states that the bedroom door is locked from the outside, windows are locked and alarmed. He alleges that this is a form of constant restraint and violates state fire codes.

INVESTIGATION SUMMARY:

The complaint investigation consisted of interviews with:
Penny Walker, Executive Director
Sean Smith, Program Director
Michele Dool, Counselor
Theresa Sitlow, Compliance Officer
2 clients and 1 family member

Additionally a review of the following documents was conducted.
Written complaint, including addendum (received by Shelby Earnshaw)
Written response from Kids Helping Kids (received from Penny Walker, Executive Director)

DISPOSITION:

The evidence submitted is not sufficient to substantiate the allegations against Kids Helping Kids.

To the allegation of "beltlooping" ODADAS says:

Penny Walker reports that the agency stopped the practice of beltlopping in early 2004. Clients interviewed stated that this practice is not taking place at the program.

To the allegation of no privacy in restrooms, ODADAS says:

The agency reports that new clients or "newcomers" are supervised while utilizing the bathroom to ensure their safety (prevent running away and self damaging behaviors). The agency has private bathroom stalls and newcomers are accompianied to the bathroom by peers ("oldcomers") who are in a more advanced phase fo the treatment program. Peers are in the larger bathroom area and can maintain verbal contact if necessary. In the host homes "oldcomers" supervise new clients by being near the bathroom and the door is open a small fraction. Agency reports that parents and clients have not filed any grievances about this practice and the clients and family member interviewed did not indicate any objection to this agency procedure.

To the allegation of no TV, radio etc... ODADAS says:

Agency reports that in the initial phase of treatment the "newcomer" is restricted from watching TV and listening to the radio but is able to earn privileges as they progress through the program. Parents hosting "newcomers" often share information with "newcomer" parents about the client's experiences in their home. Staff are available to consult with parents 24/7. Most clients do not carry identification and are not of legal age to drive.

To the allegation of bedroom locks, sleeping in underwear ODADAS says:

The agency director reports that the program pays for alarm service for all homes that host clients. The windows and doors are alarmed in order for parents to be alerted if a child attempts to leave the house. The windows and doors are not locked and all homes are required to have a fire escape plan. All host homes are inspected  by a licensed social worker. Interviews with clients and agency personnel support that these practices are complied with.

To the allegation of Addendum to Complaint, ODADAS says:

Penny Walker reports that Dr. Corcoran has been utilized to conduct research while employed at the University of Cincinnati. He does not provide any alcohol and drug addiction treatment services or supervision of staff.

To the allegation of TSDRCP being administratively dissolved in Kentucky and operating a DRUG TREATMENT program in Ohio, ODADAS says:

The Ohio Department of Alcohol and Drug Addiction Services requires an agency to be in good standing in the state of Ohio and has no jurisdiction over the action taken by the state of Kentucky.

To the allegation of unlicensed host homes used by program parents, ODADAS says:

The Department certifies Kids Helping Kids as an outpatient alcohol and drug addiction treatment program and does not license foster homes.

To the allegation of fraudulent assessments and fee, ODADAS says:
The Department requires that the agency completes an assessment on all clients admitted to their program. Certification inspections have verified that the agency is in compliance with this requirement. If you have any specific evidence or reports from parents that their child is not being assessed and fee is charged, please submit this information to the Department.

To the allegation of KHK using nearly identical to straight inc methods to treat adolescents for drug use issues, ODADAS says:

The complainant does not provide any specific information about what methods Kids Helping Kids are using that are abusive.

To the allegation of the redundant deficiencies that occur at each recertification interval and which will never be resolved due to the nature of the treatment modality, ODADAS says:

The agency has submitted an acceptable corrective action plan for all of the deficiencies noted above. The Department noted in an addendum to the certification report dated January 8, 2002 that the issue of client safety regarding clients assisting staff in restraining clients in an emergency situation was addressed with agency staff.

Okay, let me first refer you to the "Why did Straight close? (Newspaper Articles)" thread over on the Straight Survivors forum.

The State of Maryland decided that Straight was not an "outpatient" facility. They acknowledged that going to a host home was a form of "peer therapy".

So tell me, KHK survivors, what did you have to do at the host home? If you were on first phase, was it like at Straight, where you had to ask to pick any thing up: "May I pick up the comb?" "May I pick up my fork?" "May I get toilet paper?"

As a newcomer, was your oldcomer "aware" of you, in other words, in the same room with you, including in the bathroom?

Were you free to write or read privately, or watch television, or listen to the radio?

Were your dietary needs respected, for example, if a particular food did not tend to digest well for you, were you offered an alternate meal?

Were you ever "confronted" in the "host home"?

Were you required to write M.I.s in the car or once you got to the host home, and then submit them to the "oldcomer" to read and comment on?

How much sleep did you get? Were you ever denied sleep as a "consequence"?

KHK survivors, please tell us about the five phases and the requirements and privileges or lack thereof on each phase.

Please also tell us about the graduate requirements -- "after care" or whatever you might call it.

Please tell us about the rules you had to follow.

Please tell us about the weekly schedule: what times of day you had various raps and what those raps were.

Please tell us about the use of peer confrontation. Please give a remembered or typical scenario of peer confrontation.

Please tell us about any restraining of clients that you witnessed or were subjected to. Please tell us what the restraint looked like, specifically, and who was doing the restraining. You don't have to name names if it makes you uncomfortable, just say what role the restrainers had in KHK, whether they were clients or staff.

Please be sure to say Why the restraint happened, and how you know this.

2:45p.m. "let's have a song"
3:00p.m. "3:00 rap"
5:00p.m. "dinner" yeah right, Gross!
5:45p.m. "responsibilities"
6:30p.m. "rules rap"
7:00p.m. "songs"
7:10p.m. "Night rap"
8:00p.m. "homes" Where ye found out who was going to whose home for the night etc...
9:00p.m. off to the "Host Home", aka foster home.
M.I.'s must be written at this time or ye may risk getting restrained depending upon which oldcomer ye have for that particular night.

The daily schedule is something like this though.

This is pretty much how I remember it too.......I was also in KHK in Hebron in 1989-1990. I have done my best to block out most of it, and go on with my life the best I can. All I can say is it was one fucked up place.
I would also like to comment on the bathroom time while on 1st phase, if I remember right we were not allowed to shave our legs, the old comer had to do this for us.
I think it was rather degrading having someone watch me poop...or watching someone else poop for that matter, to this day I still have a had time taking a dump in a public place. Even worse, having to change a tampon w/ someone watching. LOL I remember hearing a story where an new-comer had thrown a dirty one at an old-comer. :razz:

Ok,dammit. This pissed me off. I will work on a rebuttal to this. If people give me some info. I survived(and sued) Cincinnati Straight. I didn't mean for it to come back under a different name in the same damn building. I have worked with ODADAS as I had been a drug/alcohol counselor for twelve years. I am currently working on getting my Licensed Chemical Dependency Counselor III and have a Master of Science in Addiction Studies. Perhaps some of this background may help, dig through this garage and hit on some points that will get ODADAS' attention. Here are the areas that I think should be pressed the most:

Oh my god, thank you all so much for helping out with this! It will really help to some KHK survivors involved, and if there are folks from earlier versions/locations who can help with this that would be excellent. Please contact isaccorp@yahoo.com with ANY information that you can help out with whatsoever. Thank you again. Let's get this institution, which is KNOWN to be abusing children, closed down. And if that statement is incorrect, then KHK can damn well sue me. But they won't, because they damn well know for a FACT that they are using known thought reform/mind control techniques that are known for a FACT to be damaging. That there is the chief, indisputable child abuse.

Agency reports that parents and clients have not filed any grievances about this practice and the clients and family member interviewed did not indicate any objection to this agency procedure.





To the allegation of no TV, radio etc... ODADAS says:





Agency reports that in the initial phase of treatment the "newcomer" is restricted from watching TV and listening to the radio but is able to earn privileges as they progress through the program. Parents hosting "newcomers" often share information with "newcomer" parents about the client's experiences in their home. Staff are available to consult with parents 24/7. Most clients do not carry identification and are not of legal age to drive.





To the allegation of bedroom locks, sleeping in underwear ODADAS says:





The agency director reports that the program pays for alarm service for all homes that host clients. The windows and doors are alarmed in order for parents to be alerted if a child attempts to leave the house. The windows and doors are not locked and all homes are required to have a fire escape plan. All host homes are inspected  by a licensed social worker. Interviews with clients and agency personnel support that these practices are complied with.





To the allegation of Addendum to Complaint, ODADAS says:





Penny Walker reports that Dr. Corcoran has been utilized to conduct research while employed at the University of Cincinnati. He does not provide any alcohol and drug addiction treatment services or supervision of staff.





To the allegation of TSDRCP being administratively dissolved in Kentucky and operating a DRUG TREATMENT program in Ohio, ODADAS says:





The Ohio Department of Alcohol and Drug Addiction Services requires an agency to be in good standing in the state of Ohio and has no jurisdiction over the action taken by the state of Kentucky.





To the allegation of unlicensed host homes used by program parents, ODADAS says:





The Department certifies Kids Helping Kids as an outpatient alcohol and drug addiction treatment program and does not license foster homes.





To the allegation of fraudulent assessments and fee, ODADAS says:


The Department requires that the agency completes an assessment on all clients admitted to their program. Certification inspections have verified that the agency is in compliance with this requirement. If you have any specific evidence or reports from parents that their child is not being assessed and fee is charged, please submit this information to the Department.





To the allegation of KHK using nearly identical to straight inc methods to treat adolescents for drug use issues, ODADAS says:





The complainant does not provide any specific information about what methods Kids Helping Kids are using that are abusive.





To the allegation of the redundant deficiencies that occur at each recertification interval and which will never be resolved due to the nature of the treatment modality, ODADAS says:





The agency has submitted an acceptable corrective action plan for all of the deficiencies noted above. The Department noted in an addendum to the certification report dated January 8, 2002 that the issue of client safety regarding clients assisting staff in restraining clients in an emergency situation was addressed with agency staff.
