Buccellato Committed Perjury or Lied to Parents?

Exerpted verbatim from Document 57, Case 2:06-cv-00146-WCO, a sworn affadavit from Leonard Buccellato:

Dr. Leonard Buccellato, who upon being duly sworn, testifies as follows:

4.  "...Since September 1, 2006, 42 of the 120 employees of HLA have been terminated due to decreased revenues."

5.  "Despite reductions in the number of staff and reductions in the salaries of those who remained employed by HLA, HLA's revenue is insufficient to cover its expenses (mortgage, payroll, utilities, etc.) each month."

6.  "Due to the dire financial situation faced by HLA, further reductions in the number of staff employed by HLA or closure of the school is imminent."

7.  "Further staff reductions will result in a decreased quality of service to...students."

8.  "Even more troublesome is the imminent threat of closure of HLA..."

9.  "HLA...will not likely survive two months..."

"....We are not making plans to close the school...  

...a couple of misinformed individuals perpetrated the idea, and continue today to speculate without any benefit of a knowledgeable base-in-fact...  

We are not short staffed as a few would like you to believe...  

Young single staff in particular, become dissatisfied with the amount of social and living amenities offered within the area and make the decision to leave in favor of a city or urban area. Some of our staff come to us through the local military community, which are subject to duty transfers more now than ever and leave...  

Again, we are not short staffed...

It is school as usual..."

Obviously, one set of statements is true and one set is false.  

The question remains, "Did Buccellato perjure himself to the court, or is he continuing to lie to parents of children at HLA?"

Parents, you must review the public record.  You don't have to believe anything you read here.  Go to the source.  Compare Buccellato's sworn affadavit to the court with the email he authored to you.  

Does it pass the smell test? Is this an honest broker?  Is this someone who should be entrusted with the care of your child?  If he would lie to you or to the court about serious matters like this, what else may have you been misled about?  Look into it.  Go to the source documents.  See for yourself.  Your child and family deserve your effort to find the truth hidden in the lies.

I'm unaware of what the judge knows, but it's doubtful it would have gotten to his attention this quickly.  I am aware, however, that the palintiffs and their attorneys are cognizant of it and are following up.

Interestingly, despite this letter, I have been told by a few current HLA parents that as soon as they get their kids out - they are waiting until the end of the academic year - they will also be signing up to the class action suit or retaining private counsel to pursue issues they describe as "fraud."  Some related that they are "afraid" to speak up until their kids are home for fear of "retaliation" against them or their children.

This email, in my opinion, will become entered into evidence in the class case and/or other individual suits.

Summer is historically a difficult time for parents. With family vacations and general summer activities children are sorely missed. It is understandable that parents would like to have their child home early, therefore, they ask us to make academic exceptions. Doing so could seriously jeopardize our accreditation. We cannot give grades a student has not earned.

Did he put this part in just to scare parents from pulling their kids? What difference would it make if a parent pulled their kid before the term began? Are the employing the "we might lose your transcript" technique again?

Yes, they are using the not turning over the transcripts thing to parents pulling their kids out early. It is a pretty powerful thing when they tell you they will fail your kid for the school grade if they do not finish the semester after parents have invested that much money. They have parents by the KAHUNAS.  :evil:

In fact, witholding transcripts is against the law in Georgia.  they may charge a limited fee for copies, but may not withold transcripts.

If this has happened to you, lodge a complait with the DoE.  HLA will be forced to release the transcripts without delay.

Thanks for that tip. That is good to know. It states in the contract that parents sign at HLA that they will not release transcripts to you until your full balance has been paid.

Another manipulation they wont be able to get away with once the licensure kicks in.

With or without licensure they may not lawfully withold transcripts.

You may also want to lodge a complaint with ORS and SACS-CASI.  ORS may or may not be interested in this, but SACS-CASI is the accreditor and should know that HLA is unlawfully witholding student records.

I thought they could hold those transcripts if the parents signed the contract agreeing to not being able to get the transcripts until all monies had been paid to HLA.

Judge O'Kelley's decison is expected shortly as the two weeks are up tomorrow.  Either way, if he does not class the case, the private cases will all be on his desk, as the out of state parents are his jurisdiction.  The parents from Georgia will not be in his court. Each family is committed to following this thru..they are all fine, good people and it has been an honour to know them.  So, although HLA is already planning their victory dance, "it's not over til the fat lady
sings"... and "we shall not go quietly into the night"..

You can also file a complaint with the dept of ed under the FERPA laws. I'm fairly certain licensure will put a stop to this practice as an institute cannot hold transcripts provided all debts are paid.
