Outside agency to aid probe of Fla. camp

PENSACOLA, Fla. - A special prosecutor investigating the death of a 14-year-old boy beaten by guards at a juvenile boot camp said Thursday that an "independent law enforcement agency" will help with the probe because he has concerns about the Florida Department of Law Enforcement.
Mark Ober cited recently disclosed e-mails from the FDLE's commissioner to the boot camp operator that Gov. Jeb Bush has agreed were inappropriate.
FDLE Commissioner Guy Tunnell had started the Bay County boot camp when he was sheriff there, and the Bay County office under current Sheriff Frank McKeithen was running it when 14-year-old Martin Lee Anderson died Jan. 6.
In e-mails to McKeithen, Tunnell criticized those who questioned the effectiveness of boot camps.
Tunnell's e-mails with McKeithen and others also discussed FDLE's effort to withhold a video showing guards kicking, hitting and dragging the boy during a 30-minute encounter on Jan. 5.
After two lawmakers asked to see the video, Tunnell wrote in an e-mail to department staff: "Ain't gonna happen."
The department later released the video.
Bush has said Tunnell should not have communicated privately with McKeithen about the investigation. He appointed Ober as special prosecutor for the case after Bay County's prosecutor asked to be removed citing close ties with local law enforcement.
Ober, who is Hillsborough County's state attorney, said Hillsborough County Sheriff David Gee had agreed to assist with the investigation. He didn't say whether Gee would replace FDLE.
"I have determined that it is in the best interest of this investigation that an independent law enforcement agency assist my office in completing this investigation," Ober said in a statement. His Tampa-based office declined to comment further.
Tunnell offered Ober his agency's continued assistance and support.
"I express my regret for the unfortunate perception that has developed in recent days that may have caused there to be doubt about my personal integrity, and more importantly, that of my agency in regards to this critical investigation," he said in a statement released Thursday.
Bush told The Associated Press he still has confidence in Tunnell but supports Ober's decision.
"Perception matters when you're dealing with sensitive investigations, and the fact that Mr. Tunnell was the former sheriff of Bay County, then the e-mails, I think it was the right decision by Mr. Ober. It doesn't mean Guy has done anything wrong, it doesn't mean FDLE was derelict in its duties," Bush said.
Benjamin Crump, an attorney for Anderson's family, said he believed Tunnell's e-mail exchanges compromised the investigation. He said Ober's announcement was encouraging.
"I think it is a positive step on behalf of the governor and the prosecutor so that they can try and restore public confidence so people can believe the system is fair," Crump said.
In the initial autopsy, the Bay County medical examiner ruled Anderson died of complications from sickle cell trait, a common but rarely deadly blood disorder. Other experts have since challenged that conclusion, and results of a second autopsy are pending.

TALLAHASSEE - Martin Lee Anderson, the 14-year-old Panama City boy who died after being manhandled by guards at the Bay County Sheriff's Office Boot Camp, will join an elite group of other Florida children who met a tragic end:
His name will appear atop a new state measure intended to protect other kids from a similar fate.
The state House of Representatives voted unanimously Thursday to shut down the state's remaining military-style boot camps for juvenile delinquents, calling the budget item the ''Martin Lee Anderson Act.'' The provision replaces them with programs that stress education, counseling and aftercare.
Martin, who was convicted of joy riding in his grandmother's Jeep, entered the Panama City boot camp Jan. 5. He died hours after a group of guards punched and kneed him.
His death is under investigation by a Tampa-based special prosecutor appointed by Gov. Jeb Bush, and federal prosecutors are looking into the case as well.
State Sen. Tony Hill, a Jacksonville Democrat who has helped spearhead efforts by the state's legislative black caucus to hold guards accountable in the youth's death, called for ''justice'' in the case Thursday from the floor of the Senate, saying the teen was ``viciously murdered.''

Minor offenses at camp brought beatings
A smile, a mumble and other forms of nonviolent behavior resulted in force against teenage boys at a Florida sheriff's boot camp, a Miami Herald investigation found.

Views vary on how to keep juveniles' behavior in line
The teenage boys smiled, they shrugged and they smirked. They spoke without permission or they refused to speak at all.
That's all it took for the boys at the Bay County Sheriff's Office Boot Camp to provoke a swift and painful response from their guards. Even crying and ''whimpering'' brought harsh discipline.
The scenes were repeated over and over, 180 times over the past three years, at the juvenile boot camp in Panama City, according to Florida Department of Juvenile Justice records obtained by The Miami Herald under the state's public-records law.
In only eight of the 180 instances documented since January 2003 were the teenagers described as hitting guards, fighting with other youths, threatening to escape or trying to harm themselves.
The documents -- use-of-force reports written by the guards themselves -- show that the overwhelming majority of the youths were subjected to ''takedowns,'' hammer-fist blows and ''knee strikes'' for:
? Being unwilling or unable to perform rigorous exercises.
? Exercising without sufficient ``motivation.''
? Being ''insolent'' with guards.
? Speaking without permission.
? ``Breathing heavily.''
? ''Tensing'' themselves.
Boys were physically ''restrained'' for furrowing their brows, mumbling or gritting their teeth. On Christmas Day 2004, one boy was disciplined for smiling.
VIOLENT PUNISHMENT
KNEES, FISTS, THUMBS
USED FOR DISCIPLINE
Their punishments: knees jabbed forcefully into their thighs, hammer-fist punches to the arms, wrist twisting, and being wrestled to the ground. Another common tactic was the use of ''pressure points,'' in which guards used their thumbs to cause pain by pressing on sensitive areas behind the youths' ears or under their chins.
''I . . . observed offender become still and his breathing become shallow and I felt him tense his right arm. . . . I then applied a knee strike to his left thigh area,'' a sergeant wrote after one episode on Feb. 23, 2005.
In many of the cases, the guards used the tactics despite written orders by Department of Juvenile Justice chief Anthony Schembri, who in June 2004 banned the use of physical force except in extreme situations.

EXPERT FINDS `PATTERN
OF TORTURING CHILDREN'
Juvenile justice experts who reviewed the documents at The Miami Herald's request said the treatment of the youths was unjustifiable.
''What you have there is an administratively approved, systematic pattern of torturing children,'' said Ron Davidson, director of mental health policy in the psychiatry department of the University of Illinois at Chicago, who studied the 180 reports. Davidson has reviewed nearly 400 group homes, mental hospitals and juvenile justice facilities for the U.S. Department of Justice, the Illinois Department of Children & Family Services and other agencies.....................................

This story is so bizarre and outrageous, I can hardly believe it's true.
Tampa's Mark O'Hara was released from prison this week. He was serving a 25-year sentence for possession of 58 Vicodin tablets. Prosecutors acknowledge he wasn't selling the drug. They acknowledge that he had a prescription for it. At his trial, two doctors testified they'd been treating O'Hara since the early 1990s for pain related to gout and an automobile accident.
But prosecutors inexplicably brought drug trafficking charges anyway, because as the article explains, "Under the law, simply possessing the quantity of pills he had constitutes trafficking."
This is simply stunning. The man was sentenced to 25 years for possessing 58 pills for which he had a legal prescription.
Prosecutors then argued—and the trial court agreed—that the jury was not allowed to consider the fact that O'Hara had a prescription because Florida statutes governing painkillers don't allow for a "prescription defense," as if that rather crucial fact were some mere technicality those ACLU-types are always using to get criminals off the hook.
I suppose we should expect little from the state that put Richard Paey away for 25 years. But this is insanity. My guess is that O'Hara's prior drug conviction (in the 1980s) and the small amount of pot also found in his truck blinded the prosecutors' and judge's discretion. Gotta' get this guy for something, right?
O'Hara is free after an appellate court rightly deemed the trial "absurd" and tossed out the verdict. Prosecutors are apparently still considering what to do next.
Given the way they've wasted taxpayer money and court time and needlessly harassed Mr. O'Hara, in a just world their "next step" would be submitting their own letters of resignation.
