PITTSBURGH -- Two judges in eastern Pennsylvania have pleaded guilty to taking millions of dollars in kickbacks to send young people to two juvenile homes owned by the brother of Allegheny County District Attorney Stephen Zappala.

Prosecutors say Luzerne County Judges Mark Ciavarella and Michael Conahan took more than $2 million in kickbacks in exchange for sending juvenile delinquents to Western PA Child Care in northern Butler County, along with a sister facility in Luzerne.

Team 4 investigator Paul Van Osdol reported that Zappala's brother, Greg, took over control of the facilities last year from partner Robert Powell, a Luzerne County attorney who allegedly paid some of the kickbacks.

Through an attorney, Powell has said he was a victim of extortion.

On Friday, while attending an unrelated event at Woodland Hills High School, Stephen Zappala said his brother has done nothing wrong.

"My brother's out a great deal of money, so he's actually a victim in this whole thing," Stephen Zappala said.

A draft state audit found Western PA Child Care paid a half-million dollars in consulting fees to a company owned by Greg Zappala, but there was "no documentation of any services provided for these fees."

The audit also found the company paid $4,500 for a Florida fishing trip by Greg Zappala.

The audit has caught the attention of Allegheny County court officials.

"Certainly, it doesn't seem to me and the members of this court that those are appropriate expenses and they certainly shouldn't be passed on to the local taxpayers," Allegheny County Court Administrator Ray Billotte said.

In the past three years, Allegheny County has spent $3.7 million sending kids to Western PA Child Care. The county is not sending any more cases to the facility until it completes a review.

While Stephen Zappala prosecutes juvenile offenders, he says he does not have a conflict of interest with his brother's business.

"We don't recommend where kids are housed. That's up to a judge," Stephen Zappala said.

Corporate records show Greg Zappala's business address for his consulting firms and his former partner's address for Western PA Child Care. But it's actually the home of his father, former Supreme Court Chief Justice Stephen Zappala Sr.

A court spokesman says Zappala Sr. has absolutely no connection to any of his son's businesses and cannot imagine why Greg Zappala's former business partner would have used Zappala Sr.'s home address as a business address.

None of the Zappalas has been accused of any wrongdoing.

Ciavarella and Conahan pleaded guilty to fraud in federal court in Scranton on Thursday. Their plea agreements call for sentences of more than seven years in prison.

Both judges have been removed from the bench by the Pennsylvania Supreme Court. The court terminated Ciavarella's pay and benefits, while Conahan -- who was semi-retired but still heard cases -- has been stripped of his certification and may no longer receive per-diem pay.

The school has apparently closed but I can't find any information on when it closed.  It was a school that was classed as an alternative school.
