(SALINA, Kan.) — Michael Kelly says he went to St. John's Military School to build a better future for himself. But Kelly says he couldn't move beyond the "culture of abuse" at the school. A picture that Kelly says shows him bound and blindfolded is now part of the latest allegations against the school.

"They sent it to my mother's phone. I think they took my cell phone and most likely got her number out of there. And then sent it to her,” Kelly said.

Kelly talked to FactFinder 12 via the internet from Tennessee. He's one of the three most recent former students to join a federal lawsuit against the school.  Kelly says the picture doesn't show the worst of it.

"I have a brand on my stomach, numerous cigarette burns, and about 30 scars on my right arm,” Kelly said.

Another new plaintiff says both of his legs were broken. The complaint says staff and students "dragged him by his ankles, shaking them wildly, kicked him in the knees, demanded he stand up on his broken legs." The complaint alleges an X-ray shows the student was abused so badly, "that the bone was displaced several inches below his knee."

St. John's Military School issued a new statement following these latest allegations. It says, it denies the existence of a culture of abuse. It also says some of the allegations in the lawsuit were investigated by law enforcement.  And, no charges were filed.

"I want to get it out there that this is real. This is happening. And, I don't want other kids to suffer like I did,” Kelly said.

Kelly says he tried to kill himself by over-dosing on prescription medication.

"I didn't really want to be there after seeing everything that was happening,” Kelly said.

The picture is now part of the lawsuit. St. John's says it will respond to each allegation in the upcoming days.

St. John's Military School issued a statement in regards to the picture allegedly showing Michael Kelly. It says, in part... "St. John's cannot confirm or deny the validity or authenticity of the photograph as no discovery has been conducted in the case. Plaintiffs' counsel continues to insist on trying this matter in the media where the rules of evidence do not apply."

Our family has nothing but good things to say about our son’s education and safety at St. John’s Military School.  He has been enrolled there for two and a half years and throughout that time has never experienced any mistreatment by the school, or fellow students.

We visit our son and the campus about every six weeks and are extremely impressed with the school and the education our son is receiving there.

Our greatest fear is that allegations raised in this lawsuit could alter the terrific program at St. John’s.  We searched the country for a military school for our son before finding St. John’s, and we are so very pleased with our decision.  They have outstanding staff and the students are very respectful.  We fully support St. John’s and have the utmost confidence in our son’s attendance at the school.

US: Va. treatment center operators to pay $6.85m

The operators of a now-closed residential treatment center in southwest Virginia have agreed to a $6.85 million settlement with the state and federal governments over alleged substandard psychiatric treatment for adolescents.

The Justice Department announced the settlement Wednesday involving the former Keystone Marion Youth Center in Smyth (smith) County. The settlement involves Universal Health Services Inc. and two subsidiaries.

The government says the settlement resolves a whistleblower lawsuit filed by three former therapists at the closed center.

Justice officials say the "disturbing allegations" against Universal Health Services and its subsidiaries involved false records and claims to Virginia Medicaid in connection with shoddy care to emotionally troubled youth at the treatment center in Marion.

The government says the three therapists settled a separate discrimination claim with Universal.

Universal Health Services Inc. (UHS) and two subsidiaries have reached a settlement in a False Claims Act lawsuit with the United States and the Commonwealth of Virginia, the Justice Department announced today.   Under the settlement, UHS and its subsidiaries, Keystone Education and Youth Services LLC and Keystone Marion LLC, which did business as the Keystone Marion Youth Center, a residential facility in Marion, Va ., agreed to pay $6.85 million to the United States and the commonwealth to settle allegations that they provided substandard psychiatric counseling and treatment to adolescents in violation of Medicaid requirements, falsified records and submitted false claims to the Medicaid program.  UHS closed the Marion facility earlier this year.

This settlement resolves a whistleblower lawsuit filed by Megan Johnson, Leslie Webb and Kimberly Stafford-Payne, former therapists at the closed facility.   UHS and its subsidiaries have paid an additional amount under the terms of the agreement to the former therapists to settle their separate discrimination and attorney’s fees claims.   The United States and the Commonwealth of Virginia had intervened in the lawsuit on November 4, 2009.  

Under the False Claims Act, an entity that submits false or fraudulent claims to the government is liable for three times the government’s damages, plus a civil penalty for each false claim.   The claims settled by this agreement are allegations only; there has been no determination of liability.

“The Justice Department is committed to investigating cases in which health care providers have put patients at risk by failing to meet the appropriate standards of care,” said Stuart F. Delery, Acting Assistant Attorney General for the Justice Department’s Civil Division.  “Today’s settlement demonstrates our commitment to protecting the integrity of the Medicaid program and making sure that patients who rely on federal health programs receive the care they deserve.”

“This settlement resolves disturbing allegations that Universal Health Services Inc. and its subsidiaries in Virginia made false records and presented false claims to Virginia Medicaid in connection with sub-standard care to emotionally troubled youth at a residential treatment facility in Marion, Virginia,” said Timothy J. Heaphy, United States Attorney for the Western District of Virginia. “This result, which provides substantial reimbursement to the Virginia Medicaid program, demonstrates our strong partnership with the Virginia Attorney General’s Medicaid Fraud Control Unit and our commitment to use all available means, including civil remedies under the False Claims Act, to combat health care fraud.”

“Any organization providing substandard health services then sending inflated bills to taxpayers, as UHS is alleged to have done, can expect intense scrutiny by government investigators,” said Daniel R. Levinson, Inspector General of the Department of Health and Human Services. “Those intent on defrauding our programs should know that we will continue to work closely with State law enforcement agencies to fight Medicaid fraud.

 “This settlement, which returns a substantial sum to the Virginia Medicaid program, is a testament to the strength of such a collaborative partnership,” said Ken Cuccinelli, Virginia Attorney General. “This case sends a clear message that fraud and exploitation of our most vulnerable citizens will not be tolerated in the commonwealth.”

Acting Assistant Attorney General Delery acknowledged the efforts made by the United States Attorney’s Office for the Western District of Virginia, the Virginia Attorney General’s office, the Civil Division of the Justice Department, the Department of Health and Human Services’ Office of the Inspector General and the Commonwealth of Virginia’s Medicaid Fraud Control Unit.

This resolution is part of the government’s emphasis on combating health care fraud and another step for the Health Care Fraud Prevention and Enforcement Action Team (HEAT) initiative, which was announced by Attorney General Eric Holder and Kathleen Sebelius, Secretary of the Department of Health and Human Services in May 2009. The partnership between the two departments has focused efforts to reduce and prevent Medicare and Medicaid financial fraud through enhanced cooperation.  One of the most powerful tools in that effort is the False Claims Act, which the Justice Department has used to recover $6.7 billion since January 2009 in cases involving fraud against federal health care programs.  The Justice Department’s total recoveries in False Claims Act cases since January 2009 are more than $9 billion.

DA charges boot camp operator with assaulting two girls

PASADENA - The operator of a boot camp for troubled teens was charged Wednesday with sexually assaulting two 14-year-old girls in 2004.
Kelvin "Sgt Mac" McFarland, who operates Family First Growth Camp in Pasadena, pleaded not guilty to sexual penetration by a foreign object, forcible rape, oral copulation of a person under 16, lewd acts upon a child and unlawful sexual intercourse during a Wednesday arraignment in Pasadena Superior Court.

According to the criminal complaint, McFarland allegedly raped one girl on Dec. 12, 2004, and allegedly had unlawful sex with the second girl on March 19, 2004.

The court document doesn't say how the 42-year-old Monrovia man met the teens or where the alleged assaults occurred.

Pasadena police spokeswoman Lt. Phlunte Riddle said the incidents happened in an unincorporated area and that her department didn't do any of the interviews.

"We got some information and assisted the Los Angeles County Sheriff's Department," she said.

Sheriff's investigators couldn't be reached for comment Wednesday night.

McFarland faces a maximum sentence of 15 years in prison if convicted, according to Sandi Gibbons, a spokeswoman for the District Attorney's Office.

Gibbons said this is a new case and separate from an existing criminal case against McFarland.

On May 16, 2011, Pasadena police said he handcuffed a truant high school student and extorted $100 from her family. The 14-year-old girl claimed he also flashed what she thought to

be a police badge when he approached her.
The incident resulted in prosecutors charging McFarland in June with felony child abuse, kidnapping, false imprisonment, extortion and a misdemeanor count of unlawful use of a badge. Gibbons said he faces a 12-year sentence if found guilty.

In October, McFarland became part of a controversy that erupted after the Star-News' website posted videos of a training session at the boot camp.

The videos showed children being urged by drill instructors to drink water to the point of vomiting and a boy wearing a tire around his neck being yelled at by instructors.

McFarland can be seen in both videos. But he denied being in the videos, which were shot in 2009 when he worked for another Pasadena-area bootcamp.

Booking records show McFarland was placed in custody in lieu of $275,000 bail. He has an April 11 pretrial hearing on the kidnapping case and an April 17 preliminary hearing on the assault case. Both are being heard in Pasadena Superior Court.

According to their website, there are 15 affiliated Restoration Churches in cities across the country and 2 in Mexico.


No findings of Licensure, Accreditation or Certification were found for the 3 "churches" in Ohio.
 
It does not appear to be a licensed program either under Cincinnati Restoration Church nor United Restoration Ministries.  See:http://mentalhealth.ohio.gov/where-to-get-help/?search=zip and enter in the zip of 45212.  

They probably can't claim they need no licensure due to being a church or faith-based program because The Salvation Army and other faith-based programs are licensed in Ohio.  

ODADAS accredits chemical dependency treatment centers in OH.  I can't find any list of licensed drug rehabs on the ODADAS site. http://www.odadas.state.oh.us/public/  Last time I had to submit a written letter.

"I would not consider sending your son to the Cincinnati Restoration Church, a very close family member of mine, went there and it was awful. Definitely a very nasty and run down rehab. Very dirty place, people being there with aids, and other diseases, very nasty food, gay men hitting on straight guys, they "teach" you to speak tongues, which isn't right at all. You can't talk to them for a month, they don't give the person any messages you ask them too. Yes, the employees and whatnot are very nice, but the way they teach, there actions, and there rehab facility is not. It's just an awful place. I wouldn't recommend it at all."

"She was on heroin and wanted help, so she signed herself into Cincinnati Restoration Church. Apparently they provide free rehab services (?), but they cut her off from heroin and cigarettes cold turkey and forced her to "pray the gay away" (she was a lesbian). She signed herself out of the program after only 2 days and then found a friend's gun and shot herself in the head last Friday (3-23-2012)."

Amended suit alleges new abuses at Kansas school

WICHITA, KAN. -- A California boy attends only four days at a Kansas military boarding school where he is tormented by staff and students after breaking both his legs in separate incidents. A Tennessee student's stomach is forcibly branded as a rite of initiation. A Florida cadet breaks his hand fending off a student with a history of sexual abuse who tries to grope him, and school officials refuse to investigate or inform his parents of the attack.

These claims are the latest additions to a growing list of former cadets who allege in a federal lawsuit they were abused at St. John's Military School in Salina, Kan. An amended complaint filed Friday in federal court in Kansas City, Kan., now includes six sets of named parents who have filed on behalf of cadets, plus one ex-cadet who is now an adult. The plaintiffs come from California, Florida, Tennessee, Colorado, Texas and Illinois.

The Episcopal boarding school, which charges families nearly $30,000 per year for students enrolled in grades 6-12, draws students from across the nation.

Two new defendants are named in the revised lawsuit: The Domestic and Foreign Missionary Society of the Protestant Episcopal Church in the United States of America and the Episcopal Diocese of Western Kansas, entities which the suit says created the school.

"The parents of these kids don't want any other kids to suffer the way their kids did," said Dan Zmijewski, one of the plaintiffs' attorneys.

Their lawsuit, which was initially filed March 5, contends that the school allows and encourages older students to physically, mentally, emotionally and sexually abuse young students. According to court filings, the legal action purports to chronicle a "dangerous and disturbing culture at a boy's military school which must end."

St. John's has settled nine previous abuse-related lawsuits filed since 2006, court records show.

Amid widening media coverage of the latest lawsuit, more parents and cadets are coming forward with stories of abuse, Zmijewski said.

"It is just more kids who suffered extreme abuse at the hands of students while staff is watching - and is more indicative of what is going on there," he said.

Derek Johannsen, an attorney for St. John's, sent an email statement Saturday on the school's behalf. In it, he said the school denies the existence of a culture of abuse, and pointed out that St. John's has a 120-year history of helping young men develop skills in a safe environment.

"(The school's) objective is to provide a rigorous academic environment, opportunity for religious introspection and a structured campus life to help develop young men with the highest degree of self-discipline and self-confidence," the statement read.

Johannsen also wrote that some of the allegations in the lawsuit were investigated by law enforcement and no charges were filed. He said a formal response to the amended complaint will be filed soon.

In a separate settlement last year, the school argued it had made reasonable efforts to curb abuses, noting military schools nationwide have a problem with hazing. St. John's installed surveillance cameras in the hallways and instituted weekly bruise checks.

The new filing includes as an exhibit the California boy's X-ray, showing abuse so severe that the right femur bone was displaced several inches above the knee. Also included in the court filing is a photograph that had been posted on Facebook depicting a uniformed cadet from Texas gagged, blindfolded and bound with black duct tape.

Other allegations come from a Texas boy who was urinated on by other students in the shower, a Colorado student who was beaten in a van in front of a faculty member after trying to hitchhike home to escape earlier abuse and an Illinois cadet who suffered a fractured eye socket after being kneed in the head.

A protest against child abuse today in front of a Lima church.

Three women holding signs were out in front of Calvary Bible Church to protest the alleged abuse of children at Hephzibah House, a Winona Lake, Indiana boarding school for troubled girls.      

One of the women, Katrina Smith, was sent there when she was 15.
   
Ron Williams the founder of the boarding school was speaking at the Lima church today.                

Smith says other survivors of the home have told her about all sorts of abusive practices that are still going on like strip searches and forced vaginal exams as well as spankings administered with a long wooden paddle.  
     
Williams was not at the church while our cameras were there.
     
The pastor of Calvary Bible Church, Keith Hamblen did speak to us about their support of Hephzibah House.
     
A check of Hephzibah House's website claims they do not spank as discipline now, but instead makes those who need discipline write out a specific number of scripture verses.

With going to this school I was able to first hand witness the physical abuse of a mentally challenged 12 year old. The staff would "restrain" him for not doing as they told him to. They rubbed his face in gravel. He was a tiny kid, and calmed down easily when talked to by another student. Ricky Diaz, one of the officials, uses his power to intimidate kids into doing whatever he wants them to. You should not send your troubled teen here. I have been to three different treatment centers. This program as well as Cross Creek Program, are two programs to make an effort to avoid.

Institutions such as these are known for their use of manipulation, intimidation and verbal/physical abuse and their overreliance on isolation and restraint. These institutions have never been found to reduce the criminality of troubled young people. In fact, studies have been published that report higher rates of recidivism in teens who attend residential facilities. Reports of pervasive systemic violence and abuse have been regularly emerging from these unregulated facilities.

Despite their exorbitant daily costs, many long-term residential facilities are also ill-prepared to address the many needs of confined youth. Often, they fail to provide even the minimum services appropriate for the care and rehabilitation of youth in confinement. For example, the staff may be made up of young high school graduates who lack proper training, discipline and maturity to deal with the unique needs of this population.

In the academic world, these treatment facilities are now considered obsolete. Scholars have identified a number of interventions and treatment strategies that consistently reduce recidivism among juvenile offenders. None require - and many are inconsistent with - incarceration in correctional facilities like Diamond Ranch Academy. Multidimensional, family-focused, non-residential substance abuse treatment has been proven to be effective. Wraparound services that include intensive mentor/advocate programs, vocational training and family treatment have also shown been proven to be effective.

Scary place! I am constantly hearing tales of harrowing abuse. It seems like just another Utah facility aimed at getting as much money as possible for minimal return. These places often by their very nature breed abuse (for examples google World Wide Association of Specialty Programs, Straight inc, or watch the PBS Montana documentary "Who's watching the kids").

My daughter Jodi just returned from school at Diamond Ranch Academy a month ago. Last Christmas she was at Diamond Ranch Academy and she was struggling and we were separated, but this Christmas we were all together again and it was amazing! The contrast between this year's Christmas and last year's Christmas was incredible. She has changed so much, it's almost as if she's a new person. I can't thank Diamond Ranch Academy enough!

Ill say this all programs are the same. What I mean by this statement is they all go by the same guidelines. Some are more terrible then others. As someone who has been to a program I will tell you that it does change you. You are a changed person for the first month after that most of us fall back into our own ways and begin to build up rage towards the program. All a program is a facility ran by the SS built and designed around to look and be like a concentration camp. While In the program you feel as if your In Communist Russia. You loose so many freedoms most importantly freedom of speach.

Our son is doing GREAT.  I can't get over the transformation.  All of his teachers that knew him last year are also very impressed. He is respectful and kind to Sam and I, actually to everyone. He is also had a good football year.  He played TB, FS, kick off receiving and return. He was a team captain and his coach says that he motivated the whole team.

There isn't a day that goes by that we don't think of you and say a prayer to God for bringing you and DRA into our lives. Austin is doing sensationally. He just recently got his license and is driving himself to school in Ft Worth.  His grades are superb, he just finished finals and most of his tests were in the 90s.
Diane and I were just talking about you guys this past weekend and how we have had our miracle.   Austin is a delight to be around...which is not a phrase we would have used prior to DRA.   He has had opportunities to make wrong choices, and as far as we can tell, he has made the right choices.

Life is good. Thank you for all that you have done for our family.

So things are good!

Ok let me start out by saying this place was HELL for me and everyone else i know that went there. If anything it made things worse then better. I got sent there on April 15, 2008 and graduated May 15, 2009. I was there exactly 13 months. As people said that a kid died there. That kid was my best friend. His name was Jim. now i dont know exactly how he died or any of the details. All i do know is how the staff there treated him. It was exactly a week after he got back to the ranch from a home visit. My ENTIRE dorm woke up around 4 am thinking someone was showering. We found out that Jim was puking over the side of his bed so much it sounded like a shower running! So obviously he was sick. The staff then made him sit there for over 45 minutes cleaning up his own vomit with nothing other then paper towel. no mop no cleaning supplies just a paper towel. In the morning when we all went to breakfast he was sent to sick bay and that was the last time any of the students saw him. Now it wasnt DRAs fault that he died. but he was sick and they treated him so horribly! making him clean up his own vomit at 4 in the morning, while he was moaning and groaning and throwing up some more! Thats that story. Let me get into more of my story now. When i went there i had long hair. I got an extra week in homeless (the beginning part of the program where you can eat nothing but rice, and arent allowed to talk for at least 2 weeks) just because i didnt want to cut my hair! does that sound reasonable?! Also i was on run watch. That is where they take your shoes and give you flip flops so it is harder to run away. The reason they put me on run watch? well which one do u want? The reason they told me, the reason they told my mom, or the truth??? So they told me that my mom requested it. Later on in my program i found out that they told my mom it was because i tried to run away! When i went there i was a little fat chubby kid. even if i wanted to run away i knew i couldnt so why would i even try?! Now for the real reason. When i found out what they had told my mom i asked Ricky (program director and son of the owner) why i was on run watch in homeless. His answer? "You were on run watch because we felt like putting you on run watch"...... DRA is also physically and mentally abusive. One time i got thrown face first into the rocks and restrained because i said "screw you" to a kid. i didnt touch him, i didnt threaten him, all i said was screw you. The only reason they stopped restraining me was because my arm made a snapping noise and they were afraid they would break it. They were mentally abusive in the fact that i STILL have nightmares about that place!!! anyway let me talk about it in general and not about my story. I saw kids there that were not there for drug issues but when left got addicted to hardcore drugs because other kids there were talking about how great they were. I do not know i single person that went to dra that HASNT relapsed on what ever they were there for. Whether it was drugs or a certain behavior. DO NOT send your kids to DRA. all it will do is making them worse. It is a TERRIBLE place and i wouldnt even go back for all of bill gates money

Please, do not send your child to Diamond Ranch. It's a scam--all the nicely edited videos, all the fake testimonials, everything on their website, it's all one big organized lie. They abuse kids at this facility. I was abused there, and so were countless others. I personally knew a kid that died there as a direct result of shameful neglect; his name was James Shirey, may he rest in peace. Please don't let another human being be victimized by these people.

There are numerous ongoing lawsuits against this place, and calls to the local police do nothing due to the level of corruption in Southern Utah. Save your child and money by not sending them to this hell hole. Spend actual quality time with your children and LISTEN to them. There is nothing natural about sending your child away to become "a better person." If only life were that easy. Be the parent, step up and take responsibility for your child. They scare the occupants into not saying anything negative and the looming fear of being sent back, not to mention the brainwashing. They lie and manipulate the parents while they brainwash the children. Protect your child from this dreadful place.

Ok, this isn't me complaining about how bad DRA is, how manipulative and abusive it is, or how unsanitary it is.  This is for any parents who are considering sending their kids to DRA.  So, should you send your kid to DRA?

Short answer: NO

Long answer:  DRA claims to be a "therapeutic" boarding school, but it's basically a prison with an independent study education program.  Students are not allowed to go outside the line of sight of a staff, so there is 24/7 supervision.  DRA got kicked out of Idaho about a decade ago, and so they moved over to southern Utah in the middle of nowhere where they can do anything they want to your kid.  Examples of abusive things that the DRA staff do, speaking 100% from experience, include: physically restraining for hours at a time for simply not wanting to work, manipulating the students to keep quiet about DRA, making students sometimes shower with the door open while they watch, and making the students pull around an old fashioned ox cart.  Sound like a place where you want your kid?  Honestly, your child would be better off in juvenile hall.  And hey, at least that doesn't cost $60,000.  Also, if you send your child away for relationship issues, they will only hate you more, so don't even think about it.  Also, DRA is very unsanitary.  The water there comes from a small pond that is awkwardly warm and filled with algae.  A student has actually DIED at DRA, and all he needed was a cortizone shot and he would have been fine.  Why did this happen?  Because the "medical staff" at DRA are incompetent and you should not trust your child with them.  After reading this, you would be a complete idiot to send your kid to DRA.  If all else fails, try a wilderness program perhaps... but not Diamond Ranch Academy.

We sent our daughter here after she got expelled from high school. She absolutely hated it but it was exactly what she needed. Even now 5 years later she gripes about it but she now has a GED and is taking some college courses.

I read a few "reviews" which seemed like they were written by former students and as you can image they hated it ... but from a parents perspective the school was exactly what our daughter needed and for that we are grateful.

My son, at the age of 14, got into drugs. My wife and I really tried everything we could to help, church, counseling, therapy, tough love, nothing really worked. He just didnt see how drugs were affecting his life ... or ours.

We did some research and found Diamond Ranch Academy and are grateful we did. It took almost 2 years but he made some amazing progress and we really appreciated being a part of the process. That was really important for us.

I honestly cant say enough good things about DRA and all they did for our family.

My parents sent me here for a year. I hated being here. But of course, when you get sent away from home, who wouldnt? Diamond Ranch Academy is located in Hurricane, UT, and it is placed right in the middle of the dessert. When  I was there, it felt like I was placed in a crater. Yet this is a coed program, the girls and the boys are not allowed to have any communication with eachother, which seems pretty stupid to me because when your younger, interacting with the opposite sex is how you learn and grow. Not interacting sexually, but at least being able to talk to them. THey served good food, that was all that I looked forward to being here, but because of the portion size, most of the kids here got fat. I dont think that we got enough exercise. Alot of the parents, including mine complained. I did like how we had to work to put money in our ledgers, so we would pay rent, which was 100 a month. If you did something bad, the staff cites you, and just like in real life, you go to court for it. You could appeal a site if you wanted. It taught me that there are consequences for every action you make, whether it be good or bad. This place is expensive, and even though i was sent there over five years ago, my parents are still paying debt for sending me here. I made some true friendships here, and I have some very good memories and good times that I will never forget. Of course, I would never want to come back, unless they would give me a job there.
