For those of you following--jury selection in the trial of Charles Long, head of Buffalo Soldiers, charged with 2nd degree murder in the July 2001 death of Tony Haynes, begins October 6 in Maricopa County Superior Court, Phoenix Arizona.

Wow! How long has this been dragging on?

But this is far from demonstrating that the authorities must interpose to suppress these vices by commercial prohibitions, nor is it by any means evident that such intervention on the part of the government is really capable of suppressing them or that, even if this end could be attained, it might not therewith open up a Pandora's box of other dangers, no less mischievous than alcoholism and morphinism.

This particular death is so haunting and horrific. This boy was abused beyond belief. Forced to eat dirt and then be placed negligently in that bathtub.  Not calling 911 when he was found slumped over in the tub. Dragging his lifeless body back to the camp area where the other students could see him.
This is an example of what goes on and the type of people who work in this industry.  They really feel they can get away with just about anything.

Buckeye boot camp director on trial for death of boy, 14

The director of a ?tough love? juvenile boot camp near Buckeye went on trial Oct. 7 for his role in the 2001 death of a 14-year-old boy put in his charge.

Charles Franklin Long II, 59, is in Maricopa County Superior Court to face a charge of second-degree murder in the death of Anthony Haynes. Long is also charged with eight counts of child abuse and one count of aggravated assault stemming from the weeklong, military-style boot camp run by Long?s America?s Buffalo Soldiers Re-enactors Association.

Long maintains the allegations against him are false. The camp, which Long founded, was shut down after Haynes? death.

Haynes was among several youths who, on July 1, 2001, reportedly stood on a ?Drop on Request? line in 112-degree heat to get permission to leave the program. After several hours, Haynes, who weighed 205 pounds, started acting erratically, eating dirt, refusing to drink water and eventually collapsing in convulsions.

According to investigators, Long ordered that the boy be taken to a nearby hotel, where a room had been secured so the boot campers could bathe. Troy Hutty, a camp staff member and the father of two boot campers, took Haynes and other youths to the hotel, undressed Haynes and placed him in the bathtub, turned on the shower and left him there unsupervised.

Haynes later was found face-down in the water, and had appeared to have defecated or vomited mud. The lifeless boy then was taken back to the camp, where a staff member called 911.

Haynes was airlifted to a Phoenix hospital, where he was pronounced dead. An autopsy ruled that the cause of death was ?complications of near drowning and dehydration due to heat exposure.? The Maricopa County medical examiner called the death an accident.

Long?s defense attorney, Joann Garcia, has maintained her client is innocent because Haynes was in Hutty?s care when he died. Hutty already has pleaded guilty to the lesser offense of negligent homicide, and is expected to testify against Long.

The case has received much attention from the national media, including comprehensive coverage on the CBS television program 48 Hours Investigates.

Haynes? mother, Melanie Haynes, sent her son to Long?s camp, which was modeled after military boot camps, after the teen was caught shoplifting a toy action figure. Boys enlisted in the camp were fed an apple for breakfast, a carrot for lunch and a bowl of beans for dinner. Their ?uniform? for the Arizona desert was a black sweatshirt, black sweatpants and black hats.

Long was arrested and charged with Haynes? murder in February 2002. If convicted, he could face more than 20 years in prison.

In between, they were put through "physical training" in the desert scrub southwest of Buckeye. On the fifth day, some - those who wanted to leave - were forced to sit in the sun, maybe for hours.

Did I mention it was July? Did I mention that they were wearing black sweat suits?

What went on at the summer endurance camp run by Chuck Long during the summer of 2001 was an outrage. It's shocking that Long had those kids out there in the desert in July - and that parents allowed it. It's a full-out tragedy that a 14-year-old boy died.

Parents were advised to provide a uniform before their kids headed to the desert on June 27, 2001 -a black sweatshirt, black sweatpants and black knit hat.
[What's striking about this is that the parents did provide the black 'uniform' in the middle of summer and didn't think a thing about it. Truely amazing!]

And this, is how most get off, avoid consequences for killing a kid:
Now, Long is on trial, charged with second-degree murder and child abuse. And who wouldn't want to see this guy punished? Maybe even dressed in black sweats and dumped out there in the desert. [Wow, sounds like something I'd say. An eye for an eye. Wanna bet he'll be convicted of the lesser of the charges, if anything?]

But I've got to ask: Was it really murder?

Negligence, sure. Manslaughter, maybe. But murder?

In their zeal to avenge Anthony's death, it looks to me like prosecutors have OVERCHARGED ONE GUY AND LET ANOTHER OFF THE HOOK. Now, they're FACED WITH CONVINCING A JURY THAT IT WAS MURDER OUT THERE IN THE DESERT. That's going to be tough to prove.

For one thing, Anthony's death was ruled accidental. He died of complications from nearly drowning and dehydration.
[Uh, wouldn't an accident be if someone was swimming and got a cramp? Dehydration caused by being marched or made to stand in 100* weather wearing black clothing is not an accident by any stretch of the imagination. Isn't this considered common knowledge/sense? What would the charges against a parent be, for doing the same thing?]

For another, prosecutors gave a deal to the guy who was actually there when Anthony died.

Hutty - the man who put the boy in a tub and left him - was allowed to plead guilty to negligent homicide in exchange for testifying against Long.
[Yeh, hope his testimony is more damning than Hale's was against Skyline Journey- who testified that she thought they all did a good job.]

As a reward, he'll get probation. [How nice. Still working with kids?]

It was surly negligent to take this child to a motel instead of a hospital emergency room or even an urgent care center.  These idiots were not qualified to treat him. He was obviously suffering from heat exhastion and for them to try to treat it themselves was extremely negligent. For them to leave him alone in the bath tub was also negligent.  Wasn't there some sort of medical service nearby? And then - when they found him uncounscious and slumped over in the bath tub - they still did not call for medical assistance (911) - instead they called the director who instructed them to bring him back. He was obviously dead by then.  This is something that should not have happened. They should have immediately brought him to a clinic or hospital or called 911.  
They did not do this because they wanted to hide the fact that they were abusing these children.  This is often the case with all youth programs.  
My own child needed emergency care after being over-medicated (by forced injection) and nothing was done....
They do not want to bring the children to outside medical providers - BECAUSE they have a LEGAL duty to report all suspected child abuse. If they had brought Tony in questions would have been asked and perhaps a report to CPS would have been made.  This is why they chose the motel bathtub instead of appropriate medical care and treatment.  
As a result - Tony is dead.  Someone needs to answer for this.  Unfortunately - it will happen again due to the lack of oversight and regulation in this very abusive and fraudulent industry.

No one else has ever died attending the Buffalo Soldiers, but there have been other charges about other boot camps run by Long. Just one summer before Haynes? death, Long was running a boot camp on an Indian reservation a few hours to the north. 48 Hours Investigateshas obtained a copy of the FBI investigation into complaints lodged by kids and parents there. The allegations involve kids being kicked and beaten and denied water.

No charges were ever filed against Long that summer, and he denies any wrongdoing then or now. He says he?s the victim of lying, scheming teen-agers. Long says that Russell Abatte, Allen Kent and Angel Campbell, who have left the program, made up their stories about how they were abused, and how Haynes died. Long says they are lying.

Was Abatte covered in sugar water and left for the bees to sting him? ?Hell no. That?s bizarre,? says Long. ?He?s a liar. He's lying.?

But hospital records show Russell had extensive bee stings. Detectives who spent eight months investigating all the charges concluded the kids were telling the truth.

Support from a loyal parent:
Despite the controversy surrounding the camp, Cheri Butkowski and her husband are still hoping that Long can help their 13-year-old son, Jason. ?He was defiant. He was disrespectful,? Cheri says. ?It got to the point where? he did get violent with us.?

She tried psychologists, psychiatrists and medication. Finally she was so desperate she sent her son to Long?s program, three months after the death of Haynes.

?Right now I don?t think any of us really know how that boy died. And if that boy died because of an accident or a suicide, why should we stop using this program,? Cheri says


?Bottom line is, we take them to the extreme, to the extreme, it gets a lot of young people?s attention,? says Long.

I'm a corporal in the Buffalo Soldiers, I'm now 11, I started when I was 8 w/ my 7 year old sister. It was 3 months after Tony died. I survived!!!  I was forced to go through 3 sessions, including "The -dreadful-(deadly) summer camp." It acually wasn't too bad. Truly! I
mean at first it was real tough, but soon it got
easier. Oh sure running the Buffalo Babe (a 4 1/2
mile course through the desert) was still hard, even more so since I'm afraid of heights and part
of it's up a mountain. Other than that it wasa pretty cool, of course, back then I HATED it! I  became friends w/ his second youngest kid... well, that's all I've got to say...except don't
wear shirts that have a picture of colonel and a sign that   says ::soapbox::
