Basically, as far as I can tell and my legal knowledge is limited... very limited, the parents signed a contract with new leaf saying all legal issues would go to arbitration. The girl gets sent to some sort of wilderness program, alleges rape, and new leaf gets the whole thing tossed out of civil court based on the contract's arbitration clause.

Where the hell were the police?

The parents are suing because they claim:

1. The girl was transferred to Trails Carolina without adequate notice and
2. While at Trails Carolina, she was placed in a predominantly male group after which she was raped
3. the program is negligent in doing this.

The program is arguing:

1. The parents signed a contact stating that were something like this to happen they would seek remedy through binding arbitration and
2. there are jurisdictional issues
