Mother of teen who died at Tryon gets $2.28 million
JOHNSTOWN - Five years after a 15-year-old inmate died at a Fulton County detention center, his mother is getting a multimillion dollar settlement.
This comes after the family argued that the boy was improperly restrained with excessive force by employees at the now-closed, Tryon Residential Center.
Darryl Thompson's mother, who lives in the Bronx, will get $2.28-million-dollars, an amount recently approved by a U.S. district court judge.
Taxpayers will also pay over a million dollars in attorney fees and expenses, in a case that also led to reforms in the way juveniles are restrained at state detention facilities.
The teenager died in November 2006, after being restrained during a scuffle with two aides.
The cause of death was ruled as cardiac arrhythmia due to a stress reaction.
No criminal charges were pressed, but the boy's mother, Anntwanisha Thompson filed a civil rights case and wrongful death lawsuit, accusing the youth detention aides of using excessive force during the restraint and doing nothing to revive the boy for several minutes after he stopped breathing.
"All those Y.D.A.'s out there were trained to perform CPR on a child. It was very clear that Darryl Thompson was in distress and they failed to perform CPR on him. It's unforgivable," said Robert Keach, the Amsterdam Attorney who represented Mrs. Thompson.
"You have a child laying on the floor that you know is in distress, and you do nothing. It's unforgivable," he added.
Keach also said the case led to reforms by Commissioner Gladys Carrion of the State Office of Child and Family Services, by limiting the circumstances under which a prone restraint can be used on juvenile inmates, and by requiring more accountability for the action of employees.
The two local aides who restrained the boy, John Johnson and Robert Murphy, no longer work for the State.
The New York Attorney General's Office had no comment on the lawsuit settlement, which does not admit any liability on the State's part.

Reporter states that taxpayers will pay the $3.8 million dollars in court ordered fines. Insurance for the Residential center will cover that cost. A correction is in order. An answer to this comment would be appreciated. You have my e-mail.

Thank you for posing those questions.We checked again and the plaintiff's attorney says that the settlement money is paid with state taxpayer funds. A spokesperson for OCFS also sent us the following response:
"Settlements generally are paid from state funds appropriated to indemnify public officers and employees from liability for acts or omissions that occur while such officers and employees are acting within the scope of their public employment or duties in accordance with Section 17 of the Public Officers Law."
