About a week ago a friend asked me to help put up a website regarding Dr. Harry D. Verby of the Behaviorial Medical Center in San Mateo Ca.  While the main page is pretty simple and nondescript, the attached documents tell the story of a doctor who slept with his patient, prescribed her a multitude of pills, and for some unknown reason, despite the fact she was suicidal, eventually decided to give her a gun, with which she used to kill herself.  For the last act he was reprimanded, but the question still remains as to whether he is "treating" his current patients in a similar manner.  This website will allow prospective parents of Dr. Verby to make informed decisions as to whether they really want him as a therapist.

Perhaps it is just my computer, but both links for the "public letter of reprimand" give me empty downloads (blank page).

Nah... I'm a flawless survivor! I find it entirely believable, however, that my computer is on drugs!!  :D   :D

Try right clicking and saving the file (they're pdfs).  It works fine here.  What browser are you using?

The letter from the California State Medical Board Executive Office states that “This case has been thoughtfully and extensively reviewed.” It is clear from the disparity of the content of that letter from the Reprimand issued by the medical board that this is not the case.
The letter from the Medical Board of California erroneously claims, “Because the expert made no finding relating to anything other than record keeping, the office of the Attorney General could not charge any other violation of the law.”
 
The falsehood of that statement can be discerned by actually reading the Order of the Public Letter of Reprimand and the Public letter of Reprimand.

The letter signed by Barb Johnston acknowledges that the medical board is “obligated to operate within the parameters of the laws established for that agency.”
 
According to Business and Professions code sections 2233-2233. “The board may, by stipulation or settlement with the affected physician and surgeon, issue a public letter of reprimand after it has conducted an investigation or inspection as provided in this article, rather than filing or prosecuting a formal accusation. Use of a public reprimand shall be limited to minor violations and shall be issued under guide lines established by regulations of the board.

Why is this guy still allowed to practice? He ought to be in jail for that.

If you read the documents, it basically explains that...  or at least the reasons why the Medical Board didn't persue it further.  They claimed their hands were tied, basically.

Nothing proportional to the deviations from the standard of care that resulted in the loss of that girl’s life seem adequately dealt to him by the issuance of an admonishing letter.
At the very least this guy should have lost his license.
He jumped from pediatrics to pseudo psychiatry?

It seems like he’s found a way to gain access to society's most vulnerable people.

Pursuant to the authority of the California Business and Professions Code section 2233, you are hereby issued this Public letter of Reprimand by the Medical Board of California.

Can anyone explain how she was able to get access to this gun?

From the documents it seems like he gave her a letter addressed “To whom it may concern”, which she then brought to the range where she had previously allowed someone to negotiate that it would be kept from her, safely.
 ....bothering to find out the name of the shooting range was as unimportant to him as the safety of his patient.

Speaking from the point of view of being in the position to make that type of decision in the past I can only wonder how badly off the girl was. I remember a specific instance of a boy who repeatedly tried to slit his wrists. Finally, someone gave him a knife and told him to go ahead. He took the knife and tried to slit his wrists. Point of the story is don't give someone who is threatening suicide something to whack themselves with. Even if they weren't serious before they'll definitely be serious later after you in essence told them they aren't woth your time.

Not really sure what my response would be to the doctor other than taking him out back and monkey stomping him to the point where his brain could be mailed home to his mama.
