"In consideration for the opportunity to obtain this counseling, I promise that I will not take any legal actions in the future for anything said, done, or omitted by my case manager, Teen Challenge of St. Louis, their agents, or family members during this case management program. I agree to hold Teen Challenge of St. Louis, their agents, and family members harmless for any legal claims of negligence or damage of any sort, which a person could assert, related to the Teen Challenge of St. Louis case management programs."

Excerpt from page 15 of the Saint Louis Teen Challenge Application:

"8. I release Teen Challenge from all financial or legal responsibilities in case of accident, injury, illness or other misfortune."

Same as Benchmark's enrollment contract.  It is more than possible to create a program catoring to young adults.  I was in one.  There are ways to keep people confined against their will (for example, convincing them they signed away their rights).  Legally, it isn't possible.  But not many people know that, and even if they do, how can you attempt to enforce it when communcationi is restricted and law enforcement sides with the program (in my case, more than a few relatives of the program owner worked for the popo.).  My Mother used to be a P.O. and raved on about the 97% success rate of Teen Challenge.. and the only way to get sober is with god.  It's amazing how easy it is to disarm normally cynical people by mentioning Jesus.

Michael Kincheloe:
The Salvation Army ARC in San Diego had an almost identical document that residents were required to sign. Llyris Chiles sued them in 1996, and S.A. produced the document in court. The judge asked, "If Mr. Chiles had refused to sign this, would he have been admitted into your program?" They hemmed and hawed around, and finally were forced to answer "no." The judge ruled that the document was coercive, and therefore illegal. She awarded Llyris Chiles $4200. S.A. no longer uses that document.
