The Judge will not certify this class action

It makes me very sad to say that there is no way that this ultra conservative judge will allow certification of this class action in my opinion...even though he needs to do so. :(

Well, don't be too glum. If he were going to reject it out-of-hand he would have done so right away. Even if he fails to certify, there will be an appeal. So hang in there and let the process play out.
Remember also that HLA is a hair's breadth away from being shuttered by ORS for operating an illegal childcaring facility, so regardless of the lawsuit, I suspect ORS will be shutting them down anyway.

I wonder how much longer they will be able to operate financially.

My best guess as of last fall was the first quarter this year - by the end of March.
I know enrollment has dropped sharply and they borrowed up to their eyeballs to continue operating as well as selling off properties for cash to operate.
I still say on or about 3-1-2007.
Out of curiosity, has anyone heard an update on the ORS case? Last I heard they had until Feb. 5 to file their application for a license as a Residential Childcare Facility (or cease and desist operations) which they apperently did. Any updates on this???

They did file their application by the deadline date. I know that much. I just wonder if they close, if current families can get any of their money back? It seems to just be a waiting game at this point.
