Really "bad" kids in a program would be removed because of the whole "habeas corpus" thing about being charged with assault and or attempted murder and or manslaugther.

The scary thing is that if GB has his way and waterboarding is declared legally 'not torture' that could allow programs to adopt the technique, legally.
