Kansas couple on trial for enslaving mentally ill

KANSAS CITY, Kansas (Reuters) - A Kansas husband and wife who ran a psychotherapy practice went on trial on Tuesday on charges that they kept mentally ill people as slaves, forced them to perform sex acts on videotape and then billed Medicare nearly $1 million for the "therapy."

Prosecutors charged that Arlan Kaufman, 68, and his wife Linda Kaufman, 62, spent 18 years taking advantage of patients entrusted to their care. The couple ran a residential care facility in Newton, Kansas, where they worked with at least 20 mentally ill individuals from 1980 until 2004.

Jury selection began Tuesday for an expected five-week trial in U.S. District Court in Wichita.

 
Authorities are seeking to prove that while the couple was billing relatives and insurers for therapy, rent, utilities and food, they were forcing the residents to engage in hard manual labor in the nude on a farm the couple owned outside of town.

Prosecutors charged the residents were also forced to engage in a variety of sexually explicit acts, including masturbating, fondling each other and shaving each other's genitals, much of which was videotaped.

Patients were physically injured or restrained if they resisted, authorities charged.

Prosecutors have filed 33 criminal counts against the Kaufmans including charges of forced labor, involuntary servitude, health care fraud, mail fraud and obstruction of a federal audit.

The Kaufmans submitted just under $1 million in claims to Medicare from 1991 through 2000 and were paid $216,906, authorities said.

Defense attorneys for the Kaufmans declined to comment. The couple faces more than 200 years in prison if convicted of all the charges.

Society must place the well-being of the mentall ill over that of 'defiant teenagers'. I think that is the problem, they define all the kids in programs as hell-raisers and the typical soccer mom and dad conjure up some stereotype and BAM.. there it is. Fuck all this shit.

This industry is out of the radar screen for just about all citizens and advocates as well.

They are called:
Board and Care Facilities (B&C)
Community Living Centers (CLC)
Residential Care Facilities (RCF)

They usually house about 6 people, it could be more or less. They are just about all homes that have each client to a room, or two to a room. With a common kitchen and bathroom. Food is provided, and is usually terrible, or groceries are purchased for the residents and usually is is cheap starches with very little nutritional value.

This should be a national disaster, too bad 60 Minutes or some such show can't expose them and stay on the issue.

One of the ways that the misfit homes get away with crap is that they simply go from licensed to unlicensed.

Each community is so desperate for B&Cs that licenses to run the facilities does not stop the billing. If they did there would be a shortage of beds. So the govt. just pays, and pays with very little oversight, to no oversight. Never adequate oversight that is for sure.

The residents are always in fear of being tossed out and not finding another place to live. The residents are very ill, powerless, and at the end of their rope because family and friends don't want them living in their houses. They are too broke to get an apartment, or to share one.

Say a social SSI sheck is $700 per month. The B&C
will take $600 and give the resident $25 per week, or the $100 all at once to live on and conduct their lives. This is impossible, therefore, they are stuck.

It is a system poorly set up and that is why fraud happens.

Another problem is that all these owner's of the B&C claim they don't make enough money to improve their facilities, almost always houses.

There is no unified industry. Since there may or may not be enough money the goverment should host,
at least the initial, best practices conferences and start some trade magazines so they can learn if they do things right, they can make money and make it ok for the residents.

The industry has been at a stand still for decades.

There are probably more residents affected by this than all the people hurricanes have displaced in a 100 years.

The govt. does not declare an emergency situation for those that are sick and powerless.

They are just fucked.

How does this fall under the topic "unbelievable"??? Did anyone seriously expect anything different? Have you really, honestly, lived all your days believing that Big Brother was actually giving us our money's worth?

To err is human. To really fowl things up requires government funding.

I don't think that a drug that creates euphoria in patients with terminal diseases is having an adverse effect.

WICHITA, Kan. ? The married owners of a group home for the mentally ill were convicted Monday of enslaving its residents, forcing them to work naked and perform sex acts, and illegally billing their families and the federal government for therapy.

Arlan Kaufman, 69, and his wife, Linda, 62, were convicted of 30 federal charges, including health care fraud, Medicare fraud, forced labor and holding clients in involuntary servitude at the Kaufman House Residential Treatment Center.

The convictions could put them in prison for the rest of their lives. Federal prosecutors contended the Kaufmans controlled the lives of the mentally ill residents, including forcing them to work on their farm and deciding who could wear clothes.

The couple was accused of forcing residents to masturbate, fondle each other and shave each other's genitals ? activities Arlan Kaufman videotaped.

The Kaufmans claimed that nude therapy sessions and other treatment methods had therapeutic value for schizophrenic patients, and that having residents act out problem behavior helped them avoid repeating it. Arlan Kaufman insisted that the residents' behavior was voluntary.

Prosecutors called it abuse and said it spanned more than 20 years while the couple billed Medicare more than $216,000. The Kaufmans incorporated their unlicensed treatment center in 1980 and ran it until their arrests in October 2004.

Justice Department lawyer Kristy Parker told jurors the residents were turned into "uncompensated actors in a never-ending pornographic movie."

The defense had portrayed the couple as respected professionals who were married 40 years and raised three children of their own.

"It was therapy. No one was harmed. They were helped," Arlan Kaufman's attorney, Tom Haney, told jurors.

Linda Kaufman's attorney, Steve Joseph, argued prosecutors had no solid evidence against her. He noted that in one videotaped session, she was reading a newspaper and didn't even look at the nude resident.

The Kaufmans face up to 20 years in prison for each of the conspiracy, forced labor and involuntary servitude charges; up to 10 years for each health care fraud charges; and up to five years for each of the other charges. No sentencing date has been set.
