"We're built the exact same," said Wardle, who also spent five days hiking with August's group. "I consider him overweight. I didn't consider him obese."

Q: Are you, Wardle, taking a soup of Psych Meds that cause you to overheat, even without exertion?

Wardle claims to have hiked with Ian's group for five days and "he was hiking fine".

BS: Everyday the counselor entered that he was slow.
Ian journaled on Day2:
"I barely made the hike '2' day. If I barely made it and it was only 1 mile how could I possibly make a two or three mile hike," he wrote about his July 7 trek.
The counselor was still commenting on how "slow" he was right up until his death.

August was kept in the sun for up to an hour after he stopped hiking..

Q: Why?

Possible Answer:
During a preliminary hearing last month, Leigh Hale, a former Skyline Journey counselor, testified that she thought the boy was FAKING when he collapsed. [Gets them off everytime, cause these kids are such ace "manipulators"..and it would be just wrong to err on the side of caution.]
"It could have been as long as one hour that Ian was left in the sun," said Ken Stettler, the director of the Office of Licensing.
The Office of Licensing alleges the staff failed to recognize the symptoms of hyperthermia and treat them, the hike went beyond the ability of the weakest member of the group, administrators failed to have the appropriate professional medical person screen August for the program, and a description of the program wasn't given to a Texas doctor who cleared the teen to enroll.

"I figured it was pretty serious, but I didn't know the extent," Hale testified.
After that point, Hale said, she left August for at least 15 minutes to check on the other teens in the group. While she was on her way back to August, the other staff member discovered the teen wasn't breathing.

In another article:
She said that she never took any measures to determine Ian's temperature beyond putting a hand on his forehead, and packed no cold compresses in the medical kit she carried.
It was 45 minutes before she and another counselor moved August into the shade of a juniper tree, Hale testified.
After the boy stopped breathing, she performed cardiopulmonary resuscitation for 2 1/2 hours until emergency crews reached them, about 50 miles west of Delta in Bird Canyon, she said.

On the issue of exceeding the capabilities of the weakest member, the program contends another teen who was diagnosed with "high-functioning autism" was the slowest member of the group and therefore the weakest, according to Randy Smart, Skyline Journey's attorney.
    The state contends that the instant August stopped hiking he became the weakest member and the hike should have stopped. The group kept going though, Stettler said.

HEY !! We gotta give it to Stettler. He has finally acted as he should've from the beginning. Guess he knows that he has to act with integrity on this one. Too many people watching. He was willing to let this and other violations slide...until the DA filed charges, then he shifted gears.
Mr. Smart--well he's just not living up to his name. Or, trying to suggest how licensing and the DA should interpret the regulations.

Let's hear what Stettler had to say about "the weakest member" just 4 days after Ian's death:

The other members of August's group continued on the trail after he stopped and returned later, Stettler said. He says this is NOT A VIOLATION because the "individual who couldn't continue wasn't forced to."
However, the state regulation reads: "Hiking shall not exceed the physical capability of the weakest member of the group. If a [youth] cannot or will not hike, the group SHALL NOT CONTINUE."

And:
Stettler said he KNOWS "FOR SURE" that the temperature was under 95 degrees during the hike because program officials carried thermometers with them.

Nothing like taking the program's word for it. What kind of investigation was that? Why investigate at all... just take statements from the counselors and write up your report... as an investigation.

Stettler also alleged that a "treatment professional" didn't screen August for the program. Wardle contends a licensed school counselor did that screening and that information was provided to one of Stettler's licensing specialists.

State rules say that even one violation by a youth camp can result in license revocation and student removal, "due to the difficulty of monitoring outdoor programs and the inherent dangers of the wilderness."

WHAT'S THE HOLD UP? WITH 4 VIOLATIONS THAT DAY, AN EMT WHO "THOUGHT HE WAS FAKING" AND CHOSE NOT TO ERR ON THE SIDE OF CAUTION; SKYLINE SHOULD HAVE BEEN SHUT DOWN IMMEDIATELY.
STETTLER NEEDS TO FRY RIGHT ALONG SIDE THEM... A LICENSING DIRECTOR WHO DOESN'T KNOW THE REGS... AND HE CLAIMS TO HAVE HELPED CREATE THEM.  IT'S ALL ABOUT THE POLITICS IN UTAH.
Hale killed Ian. Plain and simple. She needs to be held "accountable"... in program lingo. And Wardle needs to close his doors and find right livlihood... not working with teens.

Has anyone heard why she left the program? Was her conscious too much to live with? Or was she fired? And is she still working with youth?

Well, it seems part of the problem might have something to do with the fact that the licensing agent responsible for monitoring Skyline Journey to make sure they were in compliance with the state's rules and regulations was a member of Wardle's church.  This person (Kelly Husbands) has since been "reassigned". The administrative judge hearing this case has up to 60 days to render a decision which of course, can be and most likely will be appealed by Skyline Journey.
