You can indict or sue a ham sandwich. Can you win? That's another story. People can be sued for harm they did not intend to inflict, for causing distress and emotional damage, pretty much anything. It usually depends on whether the suer wants to deal with the emotional hassle of the court system, more than is there a case. Look at Sue Scheff
