Really "bad" kids in a program would be removed because of the whole "habeas corpus" thing about being charged with assault and or attempted murder and or manslaugther.

Wait, don't American authorities get to pick and choose who is covered by habeas corpus priveleges?
No, only the president or someone directly delegated by him to do so. Keep it up and you'll end up extraordinarily rendered, waterboarded, kept incommunicado without an attorney, not shown any evidence, beaten, broken and ultimately released without ever being charged with anything. "No harm, no foul." It's the American Way!

The scary thing is that if GB has his way and waterboarding is declared legally 'not torture' that could allow programs to adopt the technique, legally.
