Jury awards $11.3M over defamatory Internet posts

A Florida woman has been awarded $11.3 million in a defamation lawsuit against a Louisiana woman who posted messages on the Internet accusing her of being a "crook," a "con artist" and a "fraud."
Legal analysts say the Sept. 19 award by a jury in Broward County, Fla. ? first reported Friday by the Daily Business Review ? represents the largest such judgment over postings on an Internet blog or message board. Lyrissa Lidsky, a University of Florida law professor who specializes in free-speech issues, calls the award "astonishing."

Lidsky says the case could represent a coming trend in court fights over online messages because the woman who won the damage award, Sue Scheff of Weston, Fla., pursued the case even though she knew the defendant, Carey Bock of Mandeville, La., has no hope of paying such an award. Bock, who had to leave her home for several months because of Hurricane Katrina, couldn't afford an attorney and didn't show up for the trial.
"What's interesting about this case is that (Scheff) was so vested in being vindicated, she was willing to pay court costs," Lidsky says. "They knew before trial that the defendant couldn't pay, so what's the point in going to the jury?"
Scheff says she wanted to make a point to those who unfairly criticize others on the Internet. "I'm sure (Bock) doesn't have $1 million, let alone $11 million, but the message is strong and clear," Scheff says. "People are using the Internet to destroy people they don't like, and you can't do that."
The dispute between the two women arose after Bock asked Scheff for help in withdrawing Bock's twin sons from a boarding school in Costa Rica. Bock had disagreed with her ex-husband over how to deal with the boys' behavior problems. Against Bock's wishes, he had sent the boys to the boarding school.
Scheff, who operates a referral service called Parents Universal Resource Experts, says she referred Bock to a consultant who helped Bock retrieve her sons. Afterward, Bock became critical of Scheff and posted negative messages about her on the Internet site Fornits.com, where parents with children in boarding schools for troubled teens confer with one another.
In 2003, Scheff sued Bock for defamation. Bock hired a lawyer, but he left the case when she no longer could afford to pay him.
When Katrina hit in August 2005, Bock's house was flooded and she moved temporarily to Texas before returning to Louisiana last June. Court papers that Scheff and her attorney David H. Pollack mailed to Bock were returned to Pollack's office in Miami.
After Bock didn't offer a defense, a Broward Circuit Court judge found in favor of Scheff. A jury then heard Scheff's arguments about damages. Pollack did not seek a specific amount for the harm he says Scheff's business suffered.
"Even with no opposing counsel and no defendant there, $11 million is a huge amount," says Pollack, adding that Scheff is considering whether to try to collect any money from Bock. "The jury determined this was a significant enough issue. It's not just somebody's feelings are hurt; it's somebody's reputation is ruined." [ :roll: We could only hope.]
Bock says that when she moved back to her repaired house over the summer, she knew the trial was approaching but did not know the date. She says she doesn't have the money to pay the judgment or hire a lawyer to appeal it. She adds that if the goal of Scheff's lawsuit was to stifle what Bock says online, it worked.
"I don't feel like I can express my opinions," Bock says. "Only one side of the story was told in court. Nobody heard my side."

Agreed. In fact, some of the counter-posts to Bock's opinions (i.e. Bock is "mentally unstable" & shows "continued lack of control over [her] emotions") are just as strident (if not moreso) than the opinions Bock gives about Scheff.
I call shenanigans on this case until I hear both sides of the issue, and I am mystified as to why the jury awarded Scheff millions without even hearing the other side."

She referred and continues to refer (from what we can tell, she won't disclose what programs she refers to) places that are under investigation for child abuse. She ignores the pleas of parents to stop referring to those places (Whitmore). She refused to disclose to potential parents that the Whitmore and Cheryl Sudweeks had been CHARGED with hazing. After her own harrowing experience, a Weston mom formed Parents Universal Resource Experts.

After failed attempts at family therapy and private counseling, Weston working mother Sue Schef decided to send her troubled teen to a therapeutic boarding school to ease the tension for both mother and daughter.
Schef and daughter Ashlyn, 14 at the time, pored over the literature from the few available facilities and settled on one run by The World Wide Association of Specialty Programs and Schools (WWASPS), a Utah-based organization that claims its programs can correct inappropriate behavior in children 12 and older.
Schef learned her daughter was being abused only after Ashlyn became gravely ill from food poisoning at the facility.
''Another parent from the program called me and asked how Ashlyn was doing and it was only then I found out because her daughter had managed to leak the information to her,'' Schef said. ``They either told me [Ashlyn] was lying in her letters asking for help or that contact with her was detrimental to the treatment.''
The experience led Schef to start P.U.R.E., or Parents Universal Resource Experts, an organization that assists parents in finding trustworthy programs for their children struggling with issues like addiction, violence and attention deficit disorder.
''Before P.U.R.E., there was nowhere to go,'' Schef said. ``We do all the research and legwork for them to find what is available, and then they decide where to place their teens. We prescreen these schools and programs by visiting them and interviewing not only the parents and teens who completed the program or attended the school but also those who are currently in the program or school.''
P.U.R.E. also has a suggested reading list for parents and teens. It is financed by several schools and programs as well receiving private donations, Schef said, so the service is free.
Terri Pardo of Pembroke Pines said the referral list of doctors, psychiatrists, psychologists and group therapy included an out-of-state source that was perfect for her son, Robert.
''She has firsthand experience to know what it's like to need help. You feel all alone,'' Pardo said of Schef, noting the popular perception that the parent is at fault and that more punishment is the answer. ``This gave me an alternate source from someone who went through the same thing and it was a great comfort.''
Schef's plight, and her solution, have gained the attention of the media. Dr. Phil McGraw, host of the popular psychology TV talk show, Dr. Phil, has recommended P.U.R.E. to parents.
According to a June Miami New Times article, at least six other WWASPS programs around the world have been investigated or closed during the past decade, following allegations of abuse or questionable practices.
''Teen boot camp abuse is widely known and a very serious, hot topic,'' Schef said. ``We don't want to separate the kids from the parent. We want to bring families back together.''
Schef has written a book based on similar experiences of parents, At My Wit's End, which she hopes to have published by next fall.

The lady who did the suing had a daughter in one of many WWASPS (http://en.wikipedia.org/wiki/WWASPS (http://en.wikipedia.org/wiki/WWASPS)) abusive child gulags located across the country and in various third world countries. This company will have your child kidnapped and held incommunicado for approximately three thousand dollars a month. This is a dirty secret amongst middle/upper class white families. When they don't feel like dealing with the problem child they raised, they ship them off.
Wonder where your niece or nephew got sent when they dissappeared one day and the parents said they are at a specialty school? Wonder why those parents are now attending cult meetings once every few months to continue the charade, so WWASPS can suck as much money from them as they possibly can. This is a tragedy in America right now, kids are being held in disgusting and inhumane conditions, being beaten, sexually assaulted and even murdered.

The lady suing removed her daughter after learning of the horrific abuse prevelant at these facilities, but then decided to start a referal company and make money by selling her services as an educational consultant, making one thousand dollars per child she placed in WWASPS. She continued to refer to WWASPS for six months after she pulled her own daughter out. Why would she send other kids to a program she knew was abusive for so long? $$$$$$$ Hmmm.
Eventually she has a falling out with WWASPS and then begins to speak out against them publicly and stops refering to them. Instead, she starts refering kids through her company to other programs that are now being investigated for abuse. The teen help industry is huge, and these educational consultants take advantage of desperate and fearful parents to line their greedy pockets. This should not be allowed, it is unhealthy for the entire system. She works for the schools, not the parents, isnt' there a conflict of interest there?
She is a known liar. She claimed to have a college degree on her website, lie. She claimed to have lawyers and psychologists on staff, lie. Then when another parent, the woman she sued speaks out against her hypocritical practices, she sues her. She was also a program parent, her child was abused in a program in Costa Rica. She got her son out and wanted to speak out publically and shut down wwasps. The lady doing the suing, already involved in a lawsuit with WWASPS did not want her to release information that would be ultimately used at the trial, and aparently that is where this all started. Carey started talking out against Sue, and Sue did the same exact thing WWASPS did to her, sued her.

When i knew here her kid was still in Tranquility Bay i believe. It may have been Casa. There were a few in the small listserv. I eventually lost touch since the list consisted of endless in-fighting and bickoring which seemed counterprodutive.
Still. I can't believe she would do this. When i knew here she hated WWASP with a passion. I want to hear both sides of the story. I'll google her before giving her a call.
I do think, however that suing somebody over any type of speech is reprehensible. It's not like she can't defend herself by posting in response. Fucking lawyers.

She had us all fooled... and now her and her Lawyer are trying to fool everyone else that shes some 'single mom' and not making 200,000+ a year with kickbacks from the shady programs she sends kids to.
Oh, and know why she cant sue me for saying that? COS ITS THE TRUTH!! It came out in court when WWASPS (another shady orginization that actually runs a lot of programs, where she learned how to do all this shiat sued her for defamation and lost.

Depending on Florida law, IANAL, perhaps she can appeal based on lack of proof of service. After all, it is known in this case that she was NOT notified and papers were returned to plaintiff's lawyer.

Well i'm reading it. Oh my god. How could she keep on referring people to those places. She KNEW what went on. I was in a hellhole. What the fuck. She was taking money. Boy she sure left a lot out when she posted on trekkers. No wonder she recruited me on Ton and Lon's forums... she was trying to start competition. I feel somewhat used.
Oh wonderful. She sent here son to program for ADHD. Do you know how many like that i knew. My parents were told it was a boarding school. They were thousands of miles away and i couldn't contact them.

It?s fascinating that this decision came on September 19 and virtually went unreported up until now, but a Florida woman has been awarded a startling $11.3 million in her ?Internet defamation? lawsuit. Without question, this decision has startling ramifications for Internet denizens, bloggers, and message board posters, as it makes it quite clear that folks can?t just write whatever they want regardless of facts with total impunity. As reported by WebWire (emphasis mine throughout):
It is not often a person is awarded $11.3 million dollars from a jury of their peers. But in the case of Sue Scheff and her organization Parent?s Universal Resource Experts, Inc. (PURE) v. Carey Bock, the jury felt compelled to send a very strong message ? which they have. Included in their $11.3 million dollar verdict, they awarded Sue Scheff and PURE $5 million in punitive damages. ?The punitive damages speak volumes,? says Scheff, ?it was set to punish the defendant for what she did to my children and me. Just because you don?t like someone or what they do, it does not give you carte blanche to post false statements about a person on the Internet.?
The article continued, documenting threatening Internet exchanges that are altogether too common to those that spend a lot of time at message boards or comment sections:
In the meantime, Carey Bock maliciously and intentionally started a campaign on Internet forums against Sue Scheff and her organization, PURE. According to a witness during trial, Ms. Bock?s animosity towards Ms. Scheff had to do with the fact Sue Scheff would not disclose the name of a minor who was raped and Ms. Bock needed this child?s name for a potential documentary she would profit from. Ms. Bock lost that opportunity and went on a campaign to destroy Sue Scheff and PURE. Bock accepted $12,500.00 from WWASPS? attorney, the very organization she claimed harmed her two boys, and the organization that Sue Scheff successfully defeated in a jury trial in August 2004.
One of the witnesses testified Carey Bock was infuriated that Sue Scheff would not provide her with the information about the child. The jurors saw Ms. Bock?s e-mails and postings, one of which threatened: ?Sue, you are going down, I bet you are scared to death!?
There?s no question the jury was trying to make a serious statement:
After the trial was over, the jurors waited in the hall to meet with Ms. Scheff. They embraced her and told her that they wanted to send a message that people can?t use the Internet to invade a person?s privacy or to destroy lives. They encouraged Sue Scheff to continue her good work with children and families.

This is a story about liberals, and how they can attack the Foley right wing. PURE is a group of parents who help other parents with their troubled teenagers(WHO GOT RAPED BY PEDO ADULTS IN SPECIAL HOMES - for instance). Bock is some lady from Louisiana who had her home wiped out and couldn't attend court. BROWARD COUNTY - Al gores libhaven central is the place the verdict took place upheld.
So what we have is a bunch of " cheeeeeeeeldren" pity pots- angry that someone would possibly try to "harm" the "protectors" against the molesters, or the people doing good for "problem childs"...
So they all got in a big Foley HUFF, and slapped down a gigantic award, all to "send a message" - because BOCK was so broke she couldn't even afford a lawyer...

Scheff says she wanted to make a point to those who unfairly criticize others on the Internet. ?I?m sure (Bock) doesn?t have $1 million, let alone $11 million, but the message is strong and clear,? Scheff says. ?People are using the Internet to destroy people they don?t like, and you can?t do that.?
The dispute between the two women arose after Bock asked Scheff for help in withdrawing Bock?s twin sons from a boarding school in Costa Rica. Bock had disagreed with her ex-husband over how to deal with the boys? behavior problems. Against Bock?s wishes, he had sent the boys to the boarding school.
Scheff, who operates a referral service called Parents Universal Resource Experts, says she referred Bock to a consultant who helped Bock retrieve her sons. Afterward, Bock became critical of Scheff and posted negative messages about her on the Internet site Fornits.com, where parents with children in boarding schools for troubled teens confer with one another.

My wife and I used to call these types of schools the "Bataan Death March school of behavior modification". For example, no work, no food. Work 12 to 14 hours a day and so on. They have been shut down in Mexico (holy cow, eh?) and many have been put out of business in the Western US.
FWIW, the kids could be considered as badly damaged goods before the parents shipped them off to 'get better'. I cannot offer any suggestions on how to fix kids broken by bad parenting.
