Hmmm....my point exactly Linch.

I didnt mention a thing about spam in this post.  In fact there isnt anything here I consider to be "spam" aside from the sometime flooding, hence my ranting about "spam" in the other post.  If anything goes, then wouldnt you agree that fka should let it ride?  You and I are on the same page.

The Definition of Spam
--------------------------------------------------------------------------------

The word "Spam" as applied to Email means Unsolicited Bulk Email ("UBE").

Unsolicited means that the Recipient has not granted verifiable permission for the message to be sent. Bulk means that the message is sent as part of a larger collection of messages, all having substantively identical content.

A message is Spam only if it is both Unsolicited and Bulk.

-  Unsolicited Email is normal email
(examples: first contact enquiries, job enquiries, sales enquiries)

-  Bulk Email is normal email
(examples: subscriber newsletters, customer communications, discussion lists)

 Technical Definition of Spam

An electronic message is "spam" IF:

(1)  the recipient's personal identity and context are irrelevant because the message is equally applicable to many other potential recipients;

AND

(2)  the recipient has not verifiably granted deliberate, explicit, and still-revocable permission for it to be sent.

Spam is an issue about consent, not content. Whether the UBE message is an advert, a scam, porn, a begging letter or an offer of a free lunch, the content is irrelevant - if the message was sent unsolicited and in bulk then the message is spam.

Spam is not a sub-set of UBE, it is not "UBE that is also a scam or that doesn't contain an unsubscribe link", all email sent unsolicited and in bulk is Spam.

This distinction is important because legislators spend inordinate amounts of time attempting to regulate the content of spam messages, and in doing so come up against free speech issues, without realizing that the spam issue is solely about the delivery method.

NOTHING HERE LATELY constitutes Spam.

Flooding, Yes.

It was the Gacy comment that got me. All this time I thought he looked like Bingo.

Now I have an actual picture for an avatar.

i LOVE the Bingo movie. Ginger found it about , hell, about 5 years ago, and we went into a major debate about the origins. I was just sure it had connections to the program, Ginger thought it was a coincidence. I vowed to trace down the connection I was sure existed. I spoke to the writer, who denied it, then I found out he was connected to the program thru a rock band and two former inmates of ELAN that were childhood friends of his, and one was a fellow actor in the troup that performed the play.

I liked the clown avatar. Reminded me of Insane Clown Posse.

Antigen, legally, you bear no responsibility for what may or may not (most likely not) happen to users due to their posts.  No worries there.

That being said, I don't think it's fair to pull cards because you have access to IP's, etc.

Yeah, the guy's a dick, but let him rise or fall on his own merits, right?

Well, DF, if we are talking "fair" here, how fair is it to give someone free access (not really free because it costs ginger time and money to keep the board up) only to have this guy do everything in his power to bring the site to its knees?

This isn't about personalities. IF he was just being an asshole as usual, no one would care. But the flooding and the threats would have already gotten him banned from most websites, even open posting websites.

Ginger has been more than tolerant, more than understanding, very compassionate  and has even spoke to him personally and is the one that has constantly supported him being here from a philosophical perspective.

No, it is not Ginger that deserves the criticism here. There are limits to acceptable behavior, and only one other person I know of has gotten himself banned here, and it was for similar things..disrupting the website and making threats.  As it stands, in spite of everything, he still has access to the website, and the only reason is because of Ginger's tolerance and commitment to the principals and guidlines SHE set up.

This website has done great things in the past. To see it get mired down in petty bullshit over one or two people trying to disrupt it upsets me. I will be glad when we are able to move off this subject and onto more topical discussions.

Believe it or not, I don't use drugs. Also, I only have about 1400 posts and have been here since the day Ginger opened up Fornits. I wouldn't think that 1400 posts in roughly five years is outta line, but that is just my opinion.
