Article 37
States Parties shall ensure that:
(a) No child shall be subjected to torture or other cruel, inhuman or degrading treatment or punishment. Neither capital punishment nor life imprisonment without possibility of release shall be imposed for offences committed by persons below eighteen years of age;
(b) No child shall be deprived of his or her liberty unlawfully or arbitrarily. The arrest, detention or imprisonment of a child shall be in conformity with the law and shall be used only as a measure of last resort and for the shortest appropriate period of time;
(c) Every child deprived of liberty shall be treated with humanity and respect for the inherent dignity of the human person and in a manner which takes into account the needs of persons of his or her age. In particular, every child deprived of liberty shall be separated from adults unless it is considered in the child's best interest not to do so and shall have the right to maintain contact with his or her family through correspondence and visits, save in exceptional circumstances;
(d) Every child deprived of his or her liberty shall have the right to prompt access to legal and other appropriate assistance, as well as the right to challenge the legality of the deprivation of his or her liberty before a court or other competent, independent and impartial authority and to a prompt decision on any such action.

Unfortunately, the US hasn't signed it.  Neither has Somalia.  Everyone else has.

One day after my learning from a public school official that the method of discipline for a child now is not to call the parents, but to call the police this story appears on The Drudge Report today, March 4, 2005. The rights of the parents were violated and the child violated, if not seriously damaged, by this action. In reading the description of the behavior of this child it makes one think about the behvior of a child who is on Ritalin or Adderal! I wonder....

Bottomline:
8 year old boy denied the right to fresh air and playtime as punishment- didn't 'finish his work'- an ignorant way to punish a child. Never was a good idea.

He reacts and is restrained first by school officials and then by police

Charged with Disorderly Conduct and 2 counts of Assault and Battery

The child's parents were not called when school officials failed to be able to calm him, instead the police were called.

Same ol, same ol. Bait and attack. When will they learn that the majority of people are going to react to disrespect, sometimes in unexpected ways. School staff should be trained in de-escalation techniques. There is absolutely no rational reason for things to have escalated to the point of a police arrest. I suspect the teacher was not much more emotionally mature than the child.
