A 17-year-old student at Brookhaven Youth Ranch who is accused of assaulting a teacher will be eligible for transfer to an adult prison after action Tuesday by a McLennan County grand jury.

The student, who was 16 at the time of the alleged incident, is charged with beating a teacher with a stick at the youth ranch on Rogers Hill Road near West on Sept. 9. The teacher lost consciousness, suffered a head wound and was treated at a local hospital.

He has not returned to work, said West Independent School District Superintendent Marty Crawford, who declined to identify the teacher. West ISD is responsible for supplying teachers to the ranch school.

The grand jury approved determinant sentencing proceedings in the case. Under those types of cases, a juvenile can be sent to a Texas Youth Commission facility and held there until he or she turns 19.

At that point, they are eligible to be transferred to an adult prison to complete the rest of their sentence.

The defendant in this case is charged with a first-degree felony and could be detained, under the determinant sentencing statutes, for up to 40 years.

Assistant District Attorney Robin Houston said many factors determine whether prosecutors seek determinant sentencing status for juveniles, including their age, the severity of their crime and past conduct.

Brookhaven is a placement facility for boys who have been sent there by juvenile authorities, state child protective service officials or other sources.

There is no way a teacher can teach under those conditions.  This kid will think twice before hitting someone else again.  Good argument for increasing the funding for these places.

I don't feel sorry for the child.  The punishment fits the crime.

Be interesting to know why the kid attacked the teacher. Might be something more to it all, there might not be anything at all to it all, but I'd still like to know what was going on in the kid's day.

It's hard to believe this wasn't provoked by something. Are the West ISD teachers trained in de-escalation techniques?
