Suing questions
« on: November 06, 2007, 09:22:36 PM »
is there anyway to find out for sure whether a particular program is being, or has been sued?

Do these places ever issue "hush money" that "we", the public, can not find out about?

thanks

Damn good idea for a thread! There should be an exhaustive list of programs that have had successful lawsuits filed against them and have it include as many names as possible (in case the perpetrators should happen to pop up again elsewhere..).

Perhaps ISAC or another advocate group has a list like this already?

E. coli infection spurs lawsuit
2003-04-02
by Lance Coleman
of The (Maryville, TN) Daily Times Staff

A Chattanooga resident filed a lawsuit against the owners of Peninsula Village Monday claiming she contracted E. coli while at the Louisville facility.

In Blount County Circuit Court, Catherine Russe sued Covenant Health, doing business as Peninsula Village.

According to the suit:

In June, 1999, Russe was a resident at Peninsula Village, a facility that houses about 70 teens, ages 13 to 18 years old.

Later that month, the infection control nurse at the facility reported a number of cases of diarrhea. On June 24, Russe began experiencing diarrhea, required medical care, and a culture was taken and returned positive for E. coli.

The Centers for Disease Control opened an investigation and learned Russe and a male resident shared a pattern ``indicating a single source of the E. coli outbreak.''

``The CDC, after a thorough investigation, concluded that the most likely source of the E. coli infections were meals served in the kitchen at `Peninsula Village,''' the suit said.

After onset of diarrhea, Russe's condition quickly deteriorated, she was hospitalized at Fort Sanders Hospital and then transferred to East Tennessee Children's Hospital for acute diarrheal illness.

Russe's condition didn't improve and while at Children's Hospital, her kidneys began to fail and she was transferred to University of Tennessee Medical Center. At UT, Russe was diagnosed with hemolytic uremic syndrome, a life-threatening condition for which there is no known treatment, the suit said.

Russe remained at UT for 17 days, was discharged on July 17, 1999, and has continued to suffer complications.

E. Coli was virtually unheard of until the last decade or so.  It is becoming a big concern in the US and is creeping into our schools systems.  In 2005 The United Kingdom reported 40 schools that has outbreaks which affected 157 students.  The US is now starting to experience the same thing.

Scary stuff.

Guess what else guys, I mail order organic grain. (I know, exciting.)
Recently, it had been tasting sorta’...I don't know....sour?
The other morning my roomie’ was pouring it out, looked closely,…it was infested with weevils.
I had been eating weevil and weevil pupae. That was what tasted sour.

Guess what carries e-coli? Not historically, but recently.

E-coli is running amok, not just in institutions, but ubiquitously. You can’t get raw almonds anymore for this reason. It’s corporate agriculture. They’ve polluted our country to the point we’re poisoning ourselves

No, there is no site where you can find out if a place has been sued.  Many suits are settled out of court with gag orders.  You would have to search each program name in each state and you still wouldn't find all of them.

WWASP has been sued a lot and settled some.  The class action against them  (all of their programs) is ongoing.

Straight was sued repeatedly; Phil Elberg has sued KIDS (now closed), several times winning a total of $16 million.

Almost all of the closed programs close as a result of a combination of legal attacks costing them money, regulators closing in and the media finally getting that they are abusive not "controversial."

So, if i type in a specific program, and "lawsuit", if they settled out of court, with a gag order, it may not come up?
