Sembler v Bradbury ruling on injunction issued Jan 16 2007

Judge Shames of the 6th Circut of Pinelllas County Florida issued a ruling in the Pumpgate case January 16, 2007.

There are two parts to that case.  Bradbury won the most significant part of the case December 28, 2006 when the Semblers dropped their lawsuit against him.

But part II is the injunction regarding protesting, free speech and trash collection.

A summary of the ruling in part II, the judge was ruling on Florida statute number 784.046 dealing with "Stalking".

The issue at hand is if Bradbury is a "Stalker" by collecting trash, speaking out and protesting.

The judge ruled Bradbury is a "Stalker" under that Florida statute.

The judge is saying that if you collect trash outside someone's house then it's "Stalking" in Florida.

Meaning if the cops, reporters, private citizens, or so forth collect trash in Florida, then it's 'Stalking".

Watch out Fred Sanford (Red Fox).

This opens up the door in Florida for people who have been convicted of crimes, drug crimes, or otherwise, on evidence collected soley from trash without warrant to appeal their convictions.

On behalf of those convicted, thank you Judge but Bradbury is appealing this ruling because it is an illegal ruling and the Judge is just playing to Melvin Sembler without thinking of the possible outcome of his actions.

I think the judge has made a very foolish and short sighted ruling in this case and you can read more about it in the morning.

This ruling effects all reporters, private citizens, protesters and free speech and so forth in Florida.

In any event my thoughts on the matter, looks like this matter is just getting under way.  

Sembler v Bradbury will now make case law history.

Way to go Rich.

Thanks to that judge, the media should eat up on this big time. Mel and his pump will be a household/workplace topic nationally this time.

Well I guess that egomaniac wanted fame, he's just about to get it. Can you imagine having a legacy like Mel is about to receive?

Hope he can make Letterman and Saturday Night Live this time.

The matter is being appealed to the Florida District Court of Appeals, so now this case will be cited in the future by other attorneys in legal arguments on other cases.

PUMPGATE, goes down in history!!!!!!!!!!

Mel wanted his name in light's, well he got it.

Sembler v Bradbury is now finally out of the hands of the 6th Circut of Pinellas County Florida and off to a real court.
